The Minister of Transport in exercise of the powers under section 63(1) of the Road Traffic Act 1972(1), and now vested in him(2), and of all other enabling powers, and after consultation with representative organisations in accordance with the provisions of section 199(2) of that Act, hereby makes the following Regulations:—

Commencement and citationI1

1. These Regulations shall come into operation on 1st October 1979 and may be cited as the Motor Vehicles (Designation of Approval Marks) Regulations 1979.

RevocationI2

2. The Regulations specified in Schedule 1 are hereby revoked.

InterpretationI3

3.—(1) In these Regulations—

“ Contracting State ” means a state which is a party to the International Agreement;

“ ECE Regulation ” means a regulation annexed to the International Agreement;

“ Member State ” means any State which is a member of the European Economic Community;

[F1 “ moped ” has the same meaning as in regulation 46 of the Construction and Use Regulations 1978 ; F1]

“ the International Agreement ” means the Agreement concerning the adoption of uniform conditions of approval for Motor Vehicle Equipment and Parts and reciprocal recognition thereof concluded at Geneva on 20th March 1958( 3 ) as amended( 4 ) to which the United Kingdom is a party( 5 ).

[F2 (2) A reference to a vehicle in category M1, M2, M3, N1, N2, or N3 is a reference to a vehicle described respectively as M1, M2, M3, N1, N2 or N3 in dfnECE Regulation 13 of 29th May 1969 as revised on 5th December 1973F2]

(3) A reference in these Regulations to a Schedule followed by a number is a reference to the Schedule so numbered to these Regulations.

(4) A reference in these Regulations to provision being made by an ECE Regulation in relation to a marking is a reference to the provision being made in relation thereto by the International Agreement by virtue of that Regulation.

Approval marks required by ECE RegulationsI4

4.—(1) The Minister of Transport hereby designates as approval marks the markings which, subject to paragraphs (2) and (3) of this Regulation, are in the forms shown in the diagrams in column (2) of Schedule 2, and of the sizes specified in the ECE Regulations specified in column (5) of that Schedule in relation to those markings, each such marking being a marking which—

(a)relates to the motor vehicle or motor vehicle part specified in relation to that marking in column (3) of that Schedule, and is applied to the motor vehicle part, or to the motor vehicle itself, as indicated in relation to that marking in column (4) of that Schedule; and

(b)is a marking for which the ECE Regulation specified in column (5) of that Schedule in relation to that marking makes such provision as is mentioned in section 63(1)(a) and (b) of the Road Traffic Act 1972 as respects that vehicle or part.

(2) Where in relation to a marking shown in column (2) of Schedule 2 a numbered paragraph of Schedule 3 is specified in column (6) of Schedule 2 the requirements or permitted variations provided for in that paragraph shall apply to that marking.

(3) Where—

(a)under two or more of the ECE Regulations specified in column (5) of Schedule 2 a Contracting State has approved a motor vehicle or motor vehicle part as conforming to an approved type;

(b)at least one of those ECE Regulations provides for the application to the motor vehicle or motor vehicle part of a common mark followed by the numbers of the ECE Regulations under which approval has been given; and

(c)the United Kingdom has approved the use of a common mark in such cases,

the marking on the motor vehicle or motor vehicle part, as respects those aspects specified in column (3) of Schedule 2 in relation to those ECE Regulations, may consist of a diagram comprising—

(i)the common features and numbers in the markings specified in column (2) of Schedule 2 in relation to those aspects, and

(ii)a list (placed vertically to the right of the circle in the diagram) of the numbers of those ECE Regulations, and any features or numbers which are peculiar to any of the said markings.

Approval marks required by [F3EUF3] InstrumentsI5

5.—(1) The Minister of Transport hereby designates as approval marks the markings which, subject to paragraphs (2) or (3) of this Regulation, are in the forms shown in the diagrams in column (2) of Schedule 4, and are of the sizes specified in the [F3EUF3] Instruments specified in column (5) of that Schedule in relation to those markings, each such marking being a marking which—

(a)relates to the motor vehicle or motor vehicle part specified in relation to that marking in column (3) of that Schedule, and is applied to the motor vehicle or motor vehicle part as indicated in relation to that marking in column (4) of that Schedule; and

(b)is a marking for which the [F3EUF3] Instrument specified in column (5) of that Schedule in relation to that marking makes such provision as is mentioned in section 63(1)(a) and (b) of the Road Traffic Act 1972 as respects that part.

(2) Where in relation to a marking shown in column (2) of Schedule 4 a numbered paragraph of Schedule 5 is specified in column (6) of Schedule 4 the requirements or permitted variations provided for in that paragraph shall apply to that marking.

(3) Where—

(a)under two or more of the [F3EUF3] Instruments specified in column (5) of Schedule 4 a Member State has approved a motor vehicle or motor vehicle part as conforming to an approved type;

(b)at least one of those [F3EUF3] Instruments provides for the application to the vehicle or vehicle part of a common mark; and

(c)the United Kingdom has approved the use of a common mark in such cases,

the marking on the vehicle or vehicle part as respects those aspects specified in column (3) of Schedule 4 in relation to those [F3EUF3] Instruments may consist of a diagram comprising—

(i) a rectangle surrounding the letter “e” followed by the distinguishing letter or letters or number of the Member State which granted the approval mentioned in sub-paragraph (a) above,

(ii)the number which related to such approval, and

(iii)the symbols required by the [F3EUF3] Instruments under which such approval was granted.

[F4 6. The Secretary of State for Transport hereby designates as an approval mark in respect of a replacement exhaust system to which Commission Directive 81/334/EEC relates, or any component of such a system (other than fixing hardware and pipes) a clearly legible and indelible marking consisting of—

(a)the trade mark or trade name of the manufacturer of the system or, as the case may be, the component;

(b)the manufacturer's commercial description of the system or, as the case may be, the component;

(c)the distinctive letters of the Member State whose competent authority granted type approval of the system or, as the case may be, the component as indicated in the footnote relating to paragraph 3.1.3 of Annex II of the said Commission Directive; and

(d)the number of the certificate given by the competent authority of a Member State in accordance with paragraph 4.1 of Annex II of the said Commission Directive.F4]

SCHEDULE 3 APPROVAL MARKS REQUIRED BY ECE REGULATIONS—REQUIREMENTS AND PERMITTED VARIATIONS I8,I9,I10,I11,I12,I13,I14,I15,I16,I17,I18

1. The number shown inside the circle in a marking in column (2) of Schedule 2 will be varied, where appropriate, so as to be the number assigned by the relevant dfnECE Regulation to the Contracting State which granted the approval in relation to the particular vehicle or vehicle part on which the marking is placed.

2. The number shown outside and below the circle in any such marking will be varied, where appropriate, so as to be the number assigned by the competent authority of a Contracting State to distinguish the manufacturer of the motor vehicle or motor vehicle part concerned. The said number will be close to and outside the circle in such a position relative thereto as may be authorised by the relevant dfnECE Regulation, so however that it shall be read in the same direction as the number inside the circle.

[F48 2A. The number shown outside and on the right of the circle in any such marking will be varied, where appropriate, so as to be the number assigned by the competent authority of a Contracting State to each type approved. The said number will be close to and outside the circle in such a position relative thereto as may be authorised by the relevant dfnECE Regulation, so however that it shall be read in the same direction as the number inside the circle.F48]

3. The Roman numeral shown outside and on the left of the circle in the marking relating to item No. 3 in Schedule 2 will be varied, where appropriate, to be either I or III in cases where the motor vehicle part to which the marking relates was placed in Class I or in Class III, and not in Class II, when it was approved in accordance with the requirements of the dfnECE Regulation specified in column (5) of Schedule 2 in relation to that marking.

4. The number mentioned in paragraph 2 above and the Roman numeral mentioned in paragraph 3 above may be placed in any position in relation to the circle in the said marking so long as they are diametrically opposite to each other.

5. The figure following the number 24 shown outside and on the right of the circle in the marking relating to item No. 24 in Schedule 2 (which indicates the corrected absorption coefficient of the vehicle part to which that marking relates) will be varied, where appropriate, in accordance with the requirements of the ECE Regulation specified in column (5) of Schedule 2 in relation to that marking.

6. The number shown outside and on the right of the circle in the markings relating to the items numbered 8B, 8D, 8F, 8N, 20A, 20B, 20C, 20D, 20E, 20F, 20M, 20N, 31, [F4931A, 31D, 31E, 31F and 31IF49] in Schedule 2 will be varied, where appropriate, in accordance with the requirements of the dfnECE Regulation specified in column (5) of Schedule 2 in relation to those markings.

[F50 7. The Roman numeral shown outside and on the right of the circle in the markings relating to items No. 36, 36A, 36B and 36C in Schedule 2 will be varied, where appropriate, in cases where the vehicle to which a marking relates was placed in a class other than Class II when it was approved in accordance with the requirements of the dfnECE Regulation specified in column (5) of Schedule 2 in relation to that marking.F50]

8. The arrow shown below the circle in the marking relating to item No. 6 in Schedule 2 will point right or left according to whether the category of the motor vehicle part to which the marking relates, specified in the dfnECE Regulation referred to in column (5) of Schedule 2 in relation to that item, is such that the said dfnECE Regulation requires the arrow to point right or left. The number shown above the circle in the marking relating to the said item No. 6 will be varied, where appropriate, to the numbers 1, 2a, 2b, 3 or 5 according to the requirements of the said dfnECE Regulation as to the minimum angle required for the light distribution and the level of illumination of the category of motor vehicle part to which that marking relates.

9. The arrow shown below the circle in the markings relating to [F51items numbered 7, 7A, 7C and 50F51] in Schedule 2 will—

(1) point right in cases where the photometric specifications in the dfnECE Regulation referred to in column (5) of Schedule 2 in relation to those items are satisfied as to the angle specified in that dfnECE Regulation on the right side of the vehicle;

(2) point left in cases where the photometric specifications in the said dfnECE Regulation are satisfied as to the angle specified in that dfnECE Regulation on the left side of the vehicle; and

(3) be omitted in cases where the photometric specifications in the said dfnECE Regulation are satisfied as to the angle specified in that dfnECE Regulation on both the right and the left of the vehicle.

10. The figure “1” which follows the letter “S” in the markings relating to items numbered 7B and 7C in Schedule 2 will be varied, where appropriate, to the figure “2” according to whether the category of motor vehicle part to which those markings relate has one level of illumination or two levels of illumination in accordance with the requirements of the dfnECE Regulation referred to in column (5) of Schedule 2 in relation to those items.

[F52 11. The marking relating to item 37A or 37D may be used as an alternative to the marking relating to item 37 where there is insufficient space to affix on the lamp the marking relating to item 37.F52]

12. The number mentioned in paragraph 2 above and the additional symbol prescribed by the dfnECE Regulation which relates to item No. 38 in Schedule 2 may be placed in any position round the circle in the marking so long as they are diametrically opposite to each other in relation to the circle.

13. The additional symbol AR shown above the circle in the marking relating to item No. 23A in Schedule 2 must be placed close to the circle and either above or below the “E” or to the left or right of that letter.

[F53 14.—(1) In the marking relating to [F54 items No. 16 and 16AF54] in Schedule 2 there shall be added above the circle:

(a) the letter “A” in the case of a three-point belt,

(b) the letter “B” in the case of a lap belt, and

(c) the letter “S” in the case of a safety belt which is neither a three-point belt nor a lap belt.

(2) The letters referred to in sub-paragraph (1) above shall be preceded by the letter “Z” when the safety belt is part of a restraint system.

(3) The letters referred to in sub-paragraph (1) above shall be supplemented by:—

(a) in the case of a safety belt fitted with an energy absorber, the letter “e”; and

(b) in the case of a safety belt fitted with a retractor, the letter “r” followed by:—

(i) the figure “1” if the retractor is a non-locking retractor, or

(ii) the figure “2” if the retractor is a manually unlocking retractor, or

(iii) the figure “3” if the retractor is an automatically locking retractor, or

[F55 (iv) the figure “4” if the retractor is an emergency locking rectractor, or

(v) the figure and letters “4N” if the retractor is an emergency locking retractor with higher response threshold,

followed by the letter “m” if the retractor is an emergency locking retractor with multiple sensitivity. F55]

[F56 (4) In the case of a marking prescribed at item 16A in Schedule 2, the marking shall bear a symbol consisting of a rectangle with a motor vehicle in category M1 crossed out if the safety belt is fitted with a retractor which during normal driving conditions does not restrict the freedom of movement by the wearer of the safety belt, but has special properties as regards its use in vehicles in categories M2, M3, N1, N2 and N3F56] .

15. The number mentioned in paragraph 2 above and the letter or letters mentioned in paragraph 14 above may be placed in any position round the circle in the marking so long as they are diametrically opposite each other in relation to the circle.F53]

[F57 16. The figure in the rectangle above the circle in the marking relating to item No. 24A in Schedule 2 (which indicates the corrected absorption coefficient of the vehicle part to which that marking relates) will be varied in accordance with the requirements of the ECE Regulation specified in column (5) of Schedule 2 in relation to that marking.

17. In relation to [F58 the markings prescribed at [F59 items No. 44, 44A and 44BF59,F58]] in Schedule 2—

(1) the approval number and any additional symbol outside the marking in relation to this item must be placed close to the circle, and either above or below the “E” or to the left or right of it, the digits of the approval number must be on the same side of the “E” and oriented in the same direction, and any additional symbol must be diametrically opposite the approval number;

(2) the word “universal” shall form part of the marking if the child restraint is manufactured for use in all types of vehicle, but the word “non-universal” shall form part of the marking instead of the word “universal” if the child restraint is not manufactured for use in all types of vehicle; F60 ...

(3) the figures “9–36” following the word “universal” or, as the case may be, “non-universal” shall be varied so as to show the weight group for which the child restraint is manufactured [F61 being—

(a) in the case of a marking prescribed at item 44B–

(b) in any other case–

(4) the symbol “Y” shall form part of the marking prescribed at item 44B if the child restraint contains a crotch strap in conformity with the requirements of the ECE Regulation specified in column (5) of Schedule 2 in relation to that marking F63] . F57]

[F64 17A. In relation to the marking prescribed at item No. 44C in Schedule 2 —

(1) the approval number and any additional symbol outside the marking in relation to this item must be placed close to the circle, and either above or below the “E” or to the left or right of it, the digits of the approval number must be on the same side of the “E” and orientated in the same direction, and any additional symbol must be diatmetrically opposite the approval number;

(2) the words “universal”, “restricted”, “semi-universal” or “vehicle specific” shall form part of the marking depending on the category of child restraint as defined in the dfnECE Regulation specified in column (5) of Schedule 2 in relation to that marking;

(3) the figures “9-36” following the word “universal” or, as the case may be, “restricted”, “semi-universal” or “vehicle specific”, shall be varied so as to show the weight group for which the child restraint is manufactured being —

(4) the symbol “S” shall form part of the marking if the child restraint is designed for children who have special needs as a result of either a physical or mental handicap; and

(5) the symbol “Y” shall form part of the marking if the child restraint contains a crotch strap in conformity with the requirements of the dfnECE Regulation specified in column (5) of Schedule 2 in relation to that marking. F64]

[F65 18. In relation to the marking prescribed at item 50, “11” shall appear above the circle where the direction indicator is fitted to the front of the vehicle, “12” shall appear above the circle where the direction indicator is fitted to the rear of the vehicle and “31” shall appear above the circle where the direction indicator is fitted to the side of the vehicle. In the case of a direction indicator which does not on one side attain the minimum luminous intensity prescribed up to a minimum horizontal angle for spacial light distribution H=80° (according to paragraph 7.7.1 of, and Annex 1 to dfnECE Regulation 50), a horizontal arrow shall appear, the tip of which is oriented to the side where the minimum luminous intensity according to the said paragraph 7.7.1. is complied with up to an angle of at least 80°.

19. In relation to the marking prescribed at item 50A, the letter “M” shall appear on a lamp being a rear position lamp for a moped that has a minimum value of 2 cd. F65]

[F66 20. In relation to the marking prescribed at item 30B, the suffix “S” shall be added to the number mentioned in paragraph 2 above to show that the tyre complies with the requirements on tyre rolling noise sound emissions in the dfnECE Regulation referred to in column (5) of Schedule 2. F66]

SCHEDULE 5 APPROVAL MARKS REQUIRED BY [F3EUF3] INSTRUMENTS—REQUIREMENTS AND VARIATIONS I20,I21,I22,I23,I24,I25,I26,I27,I28

1. The number shown inside the rectangle in the markings in column (2) of Schedule 4 will be varied, where appropriate, so as to be the number assigned by the relevant [F3EUF3] Instrument to the country which has granted the approval.

2. [F88Subject to paragraph 15 belowF88] the number shown outside and below the rectangle in any of the said markings will be varied, where appropriate, so as to be the number of the approval document issued for the motor vehicle part concerned. [F88The number will be close to and outside the rectangle in such a position relative to it as may be authorised by the relevant [F3 EUF3] Instrument but will be aligned so as to be read in the same direction as the number inside the rectangle.F88]

3. The Roman numeral shown outside and immediately above the rectangle in the marking relating to item No. 2 in Schedule 4 will be varied, where appropriate, to be the Roman numeral signifying the class of the motor vehicle part concerned.

4. The number mentioned in paragraph 2 above and the Roman numeral mentioned in paragraph 3 above may be placed in any position in relation to the rectangle in the said marking so long as they are diametrically opposite to each other.

5. The arrow shown outside and immediately below the rectangle in the markings relating to item Nos. 5 and 8 in Schedule 4 indicate the side on which the photometric specifications are satisfied up to an angle of 80°H on front position (side) lamps or rear position (side) lamps whose geometric angles of visibility are asymmetrical in relation to the reference axis in a horizontal direction. The absence of an arrow means that, both left and right, the photometric specifications are satisfied up to an angle of 80°H on such lamps.

6. The absence of an arrow immediately below the rectangle in the marking relating to item No. 6 in Schedule 4 indicates that, both left and right, the photometric specifications are satisfied up to an angle of 80°H on rear position (side) lamps whose geometric angles of visibility are asymmetrical in relation to the reference axis in a horizontal direction. In cases where such lamps satisfy the said specifications up to an angle of 80°H only to the left or only to the right an arrow indicating the side to which the said specifications are so satisfied shall be added immediately below the rectangle in the said marking.

7. The number shown outside and immediately above the rectangle in the marking relating to item 9 in Schedule 4 will be varied, where appropriate, to be the number 1 or 2 where the direction indicator to which the marking relates belongs to category 1 or category 2, as the case may be, specified in the [F3EUF3] Instrument referred to in column (5) in relation to that item. The arrow shown outside and immediately below the said rectangle indicates in what position such of the direction indicators to which the said marking relates as can be mounted on one side of the vehicle shall be placed. The arrow shall be directed outwards from the vehicle in the case of a direction indicator in category 1 or category 2 specified in the said [F3EUF3] Instrument, and towards the front of the vehicle in the case of a direction indicator in category 5 specified in the said [F3EUF3] Instrument.

8. The number shown in the marking relating to items [F89 20, 21, 22, 24 and 25 F89] in Schedule 4 below the rectangle surrounding the letter “e” shall be varied so as to be the type approval number relating to the motor vehicle part specified in column (3) of the said items, and that number may be placed in any convenient position near the said rectangle.

10.—(1) [F91In the markings relating to items 23, 23A and 23BF91] in Schedule 4 there shall be added above the rectangle:—

(a) the letter “A” in the case of a three-point belt,

(b) the letter “B” in the case of a lap belt, and

(c) the letter “S” in the case of a safety belt which is neither a three-point belt nor a lap belt.

(2) The letters referred to in sub-paragraph (1) above shall be preceded by the letter “Z” when the safety belt is part of a restraint system.

(3) The letters referred to in sub-paragraph (1) above shall be supplemented by:—

(a) F92 in the case of a safety belt fitted with an energy absorber, the letter “e”; ...

(b) in the case of a safety belt fitted with a retractor, the letter “r” followed by:—

(i) the figure “1” if the retractor is a non-locking retractor, or

(ii) the figure “2” if the retractor is a manually unlocking retractor, or

(iii) the figure “3” if the retractor is an automatically locking retractor, or

[F93 (iv) the figure “4” if the retractor is an emergency locking retractor, or

(v) the figure and letter “4N” if the retractor is an emergency locking retractor with higher response threshold,

followed by the letter “m” if the retractor is an emergency locking retractor with multiple sensitivity; and F93]

[F94 (c) in the case of a safety belt with a pre-loading device, the letter “p”. F94]

[F95(4) In the case of a marking prescribed at either item 23A or item 23B in Schedule 4, the marking shall bear a symbol consisting of a rectangle with a motor vehicle of category M1 crossed out, if the safety belt is fitted with a retractor which, in normal driving conditions, does not restrict the freedom of movement of the wearer of the safety belt, but has special properties as regards use in vehicles of categories M2, M3, N1, N2 and N3.F95]

[F96 11. The Roman numeral shown outside and above the rectangle in the marking relating to item No. 2A in Schedule 4 will—

(a) be I if the mirror is an interior rear-view mirror, II if the mirror is an exterior rear-view mirror fitted on a vehicle in category M2, M3, N2 or N3, and either II or III if the mirror is an exterior rear-view mirror fitted on a vehicle in category M1 or N1;

(b) be supplemented by the letter “s” if the mirror is an additional rear-view mirror as defined in Commission Directive 79/795/EEC . F96]

[F97 12. In the marking relating to item 30 in Schedule 4–

(a) the number referred to in paragraph 2 above will be placed close to the rectangle, either below the letter "e', or to the left or the right of that letter; and

(b) there shall be added, above and close to the rectangle:–

(i) the letter “A” if the device is of the energy absorption type, or

(ii) the letter “S” if the device is of the air/water separator type. F97]

[F98 13. The Roman numeral shown outside and above the rectangle in the marking relating to item 31 in Schedule 4 shall be—

(a) II , if the windscreen is made of ordinary laminated glass;

(b) III , if the windscreen is made of treated laminated glass which is not coated; or

(c) IV , if the windscreen is made of plastic glass;

14. In the marking relating to item 32 in Schedule 4, there shall be added above the rectangle—

(a) the Roman numeral V, if the window has a regular light transmittance of less than 70%;

(b) the Roman numeral VI , if the window is a double-glazed unit; or

(c) the Roman numerals V and VI separated by a hyphen, if the window is a double-glazed unit with a regular light transmittance of less than 70%.

15. Paragraph 2 above shall not apply to the marking shown in item 33, but the number shown outside and below the rectangle in the marking relating to that item shall be varied, where appropriate, so as to be the number of the relevant approval document preceded by—

(a) “00”, if approval has been granted on the basis of the tyres to which the approval applies being commercial vehicle tyres as defined in the [F3 EU F3] Instrument referred to in column (3) in relation to that item;

(b) “02”, if approval has been granted on the basis of the tyres to which the approval applies being passenger car tyres as defined in that [F3 EU F3] Instrument;

The number shall be close to and outside the rectangle but may be above or below or to the left or to the right of it but shall be aligned so as to be read in the same direction as the number inside the rectangle. [F99 The suffix “-s” shall be added to the number to show that the tyre complies with the noise emission requirements in Annex V of the [F3 EU F3] Instrument referred to in column (5) of Schedule 4. [F100 16. In relation to the marking prescribed at item No. 34 in Schedule 4 —

(a) the symbol , indicating that the burning rate of the material has been determined for both the horizontal and the vertical directions, shall be varied, where appropriate, to either of the symbols or to indicate respectively that the burning rate has been determined for either the horizontal or vertical direction;

(b) the symbol shall only form part of the marking if the component has been approved according to its melting behaviour;

(c) the symbol shall only form part of the marking if the component has been approved as a complete device;

(d) the last four digits of the number below the rectangle shall be varied so as to be the number of the approval document issued for the motor vehicle part concerned; and

(e) the symbols referred to in sub-paragraphs (a), (b) and (c) above and the number referred to in sub-paragraph (d) shall be placed in the vicinity of the rectangle.

17. In relation to the marking prescribed at item No 35 in Schedule 4 —

(a) the symbol “AI”, indicating that the component or the separate technical unit is a combination of both a vehicle alarm system and an immobilizer, shall be varied, where appropriate, to either of the symbols “A” or “I” to indicate respectively that the component or separate technical unit is either a vehicle alarm system or an immobilizer;

(b) the last four digits of the number to the right of the rectangle shall be varied so as to be the number of the approval document issued for the motor vehicle part concerned; and

(c) the combination of any symbol referred to in sub-paragraph (a) above and the number referred to in sub-paragraph (b) shall be placed in the vicinity of the rectangle.

18. The number shown outside and below the rectangle shall be in the vicinity of the rectangle and its last four digits shall be varied so as to be the number of the approval document issued for the motor vehicle part concerned.F100]

EXPLANATORY NOTE

1. Section 63(1) of the Road Traffic Act 1972, as amended by the Designation of Approval Marks (European Communities) Regulations 1973, enacts that where any international agreement to which the United Kingdom is a party, or a Community obligation, provides—

(a)

for markings to be applied:

(i)

to motor vehicle parts of any description to indicate conformity with a type approved by any country; or

(ii)

to a motor vehicle to indicate that the vehicle is fitted with motor vehicle parts of any description and either that the parts conform with a type approved by any country or that the vehicle is such that as so fitted it conforms with a type so approved; and

(b)

for motor vehicle parts or, as the case may be, motor vehicles, bearing those markings to be recognised as complying with the requirements imposed by the law of another country,

the Secretary of State may by regulations designate the markings as approval marks, and any markings so designated shall be deemed for the purposes of the Trade Descriptions Act 1968 (c. 29) to be a trade description, whether or not the markings fall within the definition of that expression in section 2 of that Act. This power is now vested in the Minister of Transport.

2. These Regulations revoke and, with amendments, re-enact the Motor Vehicles (Designation of Approval Marks) Regulations 1976 and the amending Regulations listed in Schedule 1. The chief amendments—

(1)

provide (in paragraph (3) of Regulation 5) for a marking which includes the common features and numbers of two or more Community Instruments at least one of which provides for the application of a common mark where the United Kingdom has approved the use of such mark (this provision has rendered superfluous paragraph 10 of Schedule 5 to the Regulations of 1976 as amended by the Motor Vehicles (Designation of Approval Marks) Regulations 1978 with the result that that paragraph is not re-enacted);

(2)

add to the markings which are designated as approval marks—

(a)

three markings relating to special headlamps for agricultural or forestry tractors (items 1G, 1Hand 1I in Schedule 2),

(b)

a marking relating to a filament lamp for a headlamp (item 2A in Schedule 2),

(c)

three markings relating to special sealed beam headlamps for agricultural or forestry tractors (items 5G, 5H and 5I in Schedule 2),

(d)

three markings relating to headlamps (items 8H, 8J and 8L in Schedule 2),

(e)

two markings relating to a vehicle approved in respect of its brakes (items 13 and 13A in Schedule 2),

(f)

a marking relating to reversing lamps (item 23A in Schedule 2),

(g)

a marking relating to a vehicle approved in respect of the prevention of fire risks (item 34A in Schedule 2),

(h)

two markings relating to head restraints (items 24 and 25 in Schedule 4), and

(i)

three markings relating to headlamps for agricultural or forestry tractors (items 26, 27 and 28 in Schedule 4); and

(3)

permit a variation in relation to the marking designated as an approval mark and shown at item 23A in Schedule 2 (paragraph 13 of Schedule 3).
