Wildlife and Countryside (Service of Notices) Act 1985

1985 CHAPTER 59

An Act to apply section 283 of the Town and Country Planning Act 1971 and section 269 of the Town and Country Planning (Scotland) Act 1972 to notices and other documents required or authorised to be served or given under the Wildlife and Countryside Act 1981.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

1 Service of notices.

(1)M1After section 70 of the Wildlife and Countryside Act 1981 there shall be inserted the following section—

70A Service of notices.

(1)Subject to subsection (2), section 283 of the Town and Country Planning Act 1971 and section 269 of the Town and Country Planning (Scotland) Act 1972 (which provide for the service of notices and other documents) shall apply to notices and other documents required or authorised to be served or given under this Act.

(2)Subsections (2) and (3) of the said section 283 shall not apply to a notice required to be served under paragraph 2 of Schedule 14.

(3)This section shall not affect the operation of paragraph 2(4) of Schedule 11 or paragraph 3(4) of Schedule 15..

2 Short title and extent.

(1)This Act may be cited as the Wildlife and Countryside (Service of Notices) Act 1985.

(2)This Act does not extend to Northern Ireland.
