The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred by section 84(1) of the Animal Health Act 1981(1), and of all other powers enabling them in that behalf, with the approval of the Treasury in accordance with the said section 84(1), hereby make the following Order:

Title and commencement I1

1. This Order may be cited as the Poultry Breeding Flocks, Hatcheries and Processed Animal Protein (Fees) Order 1993 and shall come into force on 30th August 1993.

Fees I2

2. There shall be paid to the Minister in respect of each transaction described in column 1 of the Schedule to this Order the fee specified opposite in column 2:

(a)in the case of the transactions in paragraph 3, by the applicant when applying for authorisation, and

(b)in any other case, by the person in whose name the holding or premises are registered under the appropriate Order, such fee being payable within 14 days of demand being made by the Minister.

Revocation I3

3. The Poultry Flocks, Hatcheries and Processed Animal Protein (Fees) Order 1992(2) is hereby revoked.

The figures in column 3 are the fees which were charged under the Poultry Flocks, Hatcheries and Processed Animal Protein (Fees) Order 1992 before the coming into force of this Order.F1]

1. Supervision by an officer of the Minister of taking samples under Schedule 2 of the Poultry Breeding Flocks and Hatcheries Order 1993(3).

£20 per ½ hour (or part thereof) of each visit £20 per ½ hour (or part thereof) of each visit

2.—(a) Examination by an officer of the Minister of samples of composite faeces taken under paragraph 3 of Part I of Schedule 2 to that Order;

(b)Examination by an officer of the Minister of the following samples taken under paragraph 2 of Part II of Schedule 2 to that Order, of—

(i)a composite meconium sample

(ii)chicks dead in shell (up to a maximum of 50)

(iii)chicks hatched from eggs (up to a maximum of 50).

3.—(a) Inspection prior to the authorisation of a laboratory for the purposes of the Poultry Breeding Flocks and Hatcheries Order 1993 or the Processed Animal Protein Order 1989(4);

(b)distribution of quality assurance samples prior to the authorisation of a laboratory for the purposes of either of those Orders;

(c)issue of an annual authorisation for the purposes of either of those Orders.

4. Inspection of a laboratory with a view to deciding whether the annual authorisation should be renewed or revoked.
