The Secretary of State for Health, in exercise of the powers conferred by section 1(1)(b) of the Community Care (Direct Payments) Act 1996( 1 ) and of all other powers enabling him in that behalf, hereby makes the following Regulations:—

Citation and commencement

1. These Regulations may be cited as the Community Care (Direct Payments) Amendment Regulations 2000 and shall come into force on 1st February 2000.

Amendment of the Community Care (Direct Payments) Regulations 1997

2. In regulation 2 of the Community Care (Direct Payments) Regulations 1997( 2 ) (persons to whom direct payments may be made), sub-paragraph (a) of paragraph (2) shall be omitted.

1996 c. 30 . As regards Wales, the functions of the Secretary of State under the Community Care (Direct Payments) Act 1996 are transferred to the National Assembly for Wales under article 2 of, and Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672 ). These Regulations therefore extend only to England.
