The Secretary of State, in exercise of the powers conferred on him by sections 6(4), 13(1) and 48(1) of the Food Safety Act 1990( 1 ), and of all other powers enabling him in that behalf, having regard in accordance with section 48(4A) of that Act to relevant advice given by the Food Standards Agency, hereby makes the following Order:

Title, commencement and extent

1. This Order may be cited as the Food (Animal Products from Belgium) (Emergency Control) (Revocation) (England and Wales) Order 2000, shall come into force on 12th May 2000 and shall extend to England and Wales.

Revocation

2.The Food (Animal Products from Belgium) (Emergency Control) (England and Wales) Order 2000( 2 ) is hereby revoked.

1990 c. 16 ; functions under the 1990 Act relating to emergency control orders, which were originally exercisable, in relation to Great Britain, by the Minister of Agriculture, Fisheries and Food or the Secretary of State, became exercisable by the Secretary of State by virtue of paragraph 8 of Schedule 5 to the Food Standards Act 1999 (c. 28) ; (in relation to Scotland those functions were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46) as read with section 40(2) of the 1999 Act; in relation to Wales, notwithstanding the transfer of those functions to the National Assembly for Wales by virtue of article 2(a) of the National Assembly for Wales (Transfer of Functions) Order 2000 (S.I. 1999/672 ) as read with section 40(3) of the 1999 Act, paragraph 5 of Schedule 3 to the Government of Wales Act 1998 (c. 38) applies in the case of this Order); regulation 13(4) of the Food Standards Act 1999 (Transitional and Consequential Provisions and Savings) (England and Wales) Regulations 2000 (S.I. 2000/656 ) authorises the Secretary of State to revoke existing Orders made by the Minister of Agriculture, Fisheries and Food under the 1990 Act; section 6(4) of the 1990 Act was amended by paragraph 6 of Schedule 9 to the Deregulation and Contracting Out Act 1994 (c. 40) and by paragraph 10(3) of Schedule 5 to the 1999 Act; sections 13(1) and 48(1) were amended by paragraph 8 of that Schedule.
