The Lord Chancellor, in exercise of the powers conferred upon him by section 99(1) of the Supreme Court Act 1981( 1 ), sections 2(1) and 26 of the County Courts Act 1984( 2 ) and section 374(1) of the Insolvency Act 1986( 3 ), hereby makes the following Order:—

Citation, commencement and interpretation

1. —(1) This Order may be cited as the Civil Courts (Amendment) Order 2000 and shall come into force:

(a) as to articles 3 and 4, on 2nd January 2001; and

(b) as to the remainder of this Order, on 3rd July 2000.

(2) In this Order, a Schedule referred to by number alone means the Schedule so numbered in the Civil Courts Order 1983( 4 ).

Changes to district registries and county courts

2. —(1) The holding of the Lichfield County Court shall be discontinued( 5 ).

(2) In Schedule 1, in the entry relating to Walsall, “Lichfield” shall be deleted from the second column.

(3) In Schedule 3 the entry relating to Lichfield shall be deleted.

3. —(1) The district registry of the High Court at Workington shall be closed and the holding of the Workington County Court shall be discontinued.

(2) There shall be a district registry of the High Court at Whitehaven.

(3) Whitehaven County Court shall have jurisdiction for the purposes of Parts VIII to XI of the Insolvency Act 1986, and its insolvency district shall be coterminous with its district for the purposes of section 2(3) of the County Courts Act 1984.

(4) In Schedule 1—

(a) the entry relating to Workington shall be deleted; and

(b) the following entry shall be inserted in its appropriate alphabetical position—

Whitehaven Whitehaven .

(5) In Schedule 3—

(a) in the entry relating to Whitehaven—

(i) in column 1, after “Whitehaven” there shall be inserted “(D.R.) ”; and

(ii) in column 2, before “Divorce” there shall be inserted “Bankruptcy ”; and

(b) the entry relating to Workington shall be deleted.

Transitional provisions in relation to Admiralty proceedings

4. —(1)Article 5 of the Civil Courts (Amendment) (No. 2) Order 1999( 6 ) shall continue to have effect, subject to paragraph (2) of this article.

(2) Whitehaven County Court shall have jurisdiction in respect of Admiralty proceedings which were commenced in or transferred to Workington County Court before 26th April 1999, and are in existence in Workington County Court immediately before this paragraph comes into force.

Directions given on behalf of the Lord Chancellor under section 2(3) of the County Courts Act 1984 will determine which court districts will include the former district of Lichfield with effect from 3rd July 2000, and that of Workington with effect from 2nd January 2001.
