DEVELOPMENT COMMISSION, (ENGLAND AND WALES)
The Development Commission (Dissolution) Order 2000

The Secretary of State, in exercise of the powers conferred upon him by section 35(1), (3), (4), (6) and (7) of the Regional Development Agencies Act 1998( 1 ) and of all other powers enabling him in that behalf, hereby makes the following Order, a draft of which has been laid before and approved by a resolution of each House of Parliament:
Citation and Commencement
1. This Order may be cited as the Development Commission (Dissolution) Order 2000, and shall come into force on the day after the day on which it is made.
Dissolution date
2. The Development Commission shall be dissolved on 1st July 2000.
Transfer of functions, property, rights and liabilities
3. On the date on which the Development Commission is dissolved:
(a) all rights and liabilities of the Development Commission relating to the property known as Units 3 and 4, Chartfield House, Castle Street, Taunton, Somerset TA1 4AS, shall transfer to the Secretary of State; and
(b) all other remaining functions, property, rights and liabilities shall transfer to the Countryside Agency( 2 ).
Application of the Superannuation Act 1972
4. —(1) The persons to whom section 1 of the Superannuation Act 1972( 3 ) applies (persons to or in respect of whom benefits may be provided by schemes under that section) shall include persons who at the time of the coming into force of this Order:
(a) are serving or have served in employment with the Development Commission; or
(b) have served but have ceased serving in employment with a Rural Community Council; and,
in either case, are members of the Development Commission (Staff) Superannuation Scheme 1984 as amended on 28th May 1991.
(2) In Schedule 1 to the Superannuation Act 1972 (bodies in respect of which there are superannuation schemes) a reference to the Development Commission shall be inserted at the appropriate point in the alphabetical list of “Royal Commissions and other Commissions”.
Consequential Amendments
5. On the date on which the Development Commission is dissolved the following provisions of the Miscellaneous Financial Provisions Act 1983( 4 ) shall be repealed: section 1(1), (2), (5), (6) and (9) and Schedule 1.

Prior to this Order being made certain property, rights and liabilities of the Development Commission were transferred to the Countryside Agency under transfer schemes made pursuant to the power in article 7 of the Development Commission (Transfer of Functions and Miscellaneous Provisions) Order 1999 (S.I. 1999/416 ).
