The Swine Fever (Movement Restriction Areas) Order 2000

Coming into force in accordance with article 1

The Minister of Agriculture, Fisheries and Food, in exercise of the powers conferred on him by sections 1 and 8 of the Animal Health Act 1981( 1 ), and of all other powers enabling him in that behalf, makes the following Order—

Citation, commencement and extent

1. This Order may be cited as the Swine Fever (Movement Restriction Areas) Order 2000; it extends to England only, and comes into force at 4 p.m. on 8th September 2000.

Declaration of movement restriction areas

2. —(1) If the Minister reasonably suspects that swine fever may exist in any place, he may make an Order declaring the area within a radius of 10 kilometres of that place to be a movement restriction area.

(2) Where an Order has been made, no person shall—

(a) move any pig off a holding in the area;

(b) move any cattle, sheep, goat or other ruminating animal off any holding in the area which has pigs on it; or

(c) move any pig out of the area.

(3) The restriction in paragraph (2)(c) shall not apply in relation to pigs which are loaded on to a vehicle outside the area and transported through it without the vehicle being loaded or unloaded.

(4) An Order made under this article shall be revoked if the Minister is satisfied that swine fever does not exist in the area and may be revoked if he makes an Order under the Swine Fever (Infected Areas Restrictions) Order 1956( 2 ) in relation to all or part of that area.

Licences

3. —(1) The Minister, or an officer of the local authority acting under the written direction of the Minister, may grant a licence permitting movement of pigs which would otherwise be prohibited.

(2) A licence under this article shall be in writing, may be subject to conditions and may be amended or revoked by notice in writing at any time.

Enforcement

4. This Order shall be enforced by the local authority.
