The Registration of Births, Deaths and Marriages (Fees) (Amendment) Order 2000

The Chancellor of the Exchequer, in exercise of the powers conferred by section 5(1) and (2) of, and paragraphs 1 and 2 of Schedule 3 to, the Public Expenditure and Receipts Act 1968( 1 ) and now vested in him( 2 ) and section 31(5F) of the Marriage Act 1949( 3 ) and of all other powers enabling him in that behalf, hereby makes the following Order—

Citation, commencement and interpretation

1. —(1) This Order may be cited as the Registration of Births, Deaths and Marriages (Fees) (Amendment) Order 2000 and shall come into force on 1st January 2001.

(2) In this Order—

(a) the principal Order” means the Registration of Births, Deaths and Marriages (Fees) Order 1999( 4 ); and

(b) a reference to a numbered column is to the column in the Schedule to the principal Order bearing that number.

Amendment of the principal Order

2. The Schedule to the principal Order is amended as follows—

(a) for the heading to column (4) (fee as from 1st April 2000) there shall be substituted “ Fee payable ”;

(b) in the entry made in respect of the Marriage Act 1949, section 27(6) (entry in marriage notice book) in column (4) for the sum “£25.00” there shall be substituted the sum “£30.00”; and

(c) after the entry made in respect of the Marriage Act 1949, section 27(7) (attendance of superintendent registrar other than at his office etc. ), there shall be inserted—

(i) in column (2) “Section 31(5F)”; and

(ii) in relation to it in column (3) “Application to reduce the 15 day period” and in column (4) the sum “£28.00”.

1968 c. 14 ; paragraph 1 of Schedule 3 was amended by section 116(1) of, and paragraph 21 of Schedule 9 to, the Friendly Societies Act 1974 (c. 46) , and by section 4 of, and paragraph 5 of Schedule 2 to, the Social Security (Consequential Provisions) Act 1992 (c. 6) , and also by section 582(1) of, and paragraph 14 of Schedule 37 to, the Education Act 1996 (c. 56) . By virtue of section 2(2) of the Marriage Act 1983 (c. 32) the reference to the Marriage Act 1949 (c. 76) in the said Schedule 3 includes a reference to that Act as amended by the 1983 Act.

References to “the Chancellor of the Exchequer” were substituted in the second column of paragraphs 1 and 2 of Schedule 3 to the 1968 Act by article 5(1) of, and paragraph 16 of Schedule 2 to, the Transfer of Functions (Registration and Statistics) Order 1996 (S.I. 1996/273 ).
