The Secretary of State, in exercise of the powers conferred upon him by paragraph 2(1) of Schedule 3A to the National Lottery etc. Act 1993( 1 ), and having received an application made for the purpose by the English Sports Council and the Arts Council of England, hereby makes the following order:

Citation and commencement

1. This Order may be cited as the Sport and Arts Joint Scheme (Authorisation) Order 2000 and shall come into force on 18th January 2001.

Authorisation of joint scheme

2. โ€”(1) The Secretary of State hereby authorises the Sport and Arts joint scheme, being the joint scheme contained in the agreement entered into between the English Sports Council (which is also known as โ€œSport Englandโ€) and the Arts Council of England on 6th December 2000( 2 ).

(2) The Schedule to this Order (which, pursuant to paragraph 3 of Schedule 3A to the National Lottery etc. Act 1993, contains a brief description of the nature and purposes of the joint scheme and other particulars about it) shall have effect.

SCHEDULE Particulars of the Sport and Arts Joint Scheme

1. The bodies participating in the Sport and Arts joint scheme (โ€œthe joint schemeโ€) are Sport England and the Arts Council of England.

2. The purpose of the joint scheme is to make grants and give other financial assistance for the development of sports and arts facilities in primary schools in England, for use by children and local communities, as part of the โ€œSpace for Sport and Artsโ€ programme (which is to be operated in co-operation with other bodies, and whose purpose is to encourage the development of such facilities).

3. The administration of the joint scheme will be undertaken by Sport England.

4. The joint scheme applies in England only.

5. The maximum amount of money that may be distributed under section 25(1) of the National Lottery etc. Act 1993 in any year under the joint scheme is ยฃ30 million.

6. The money to be distributed under section 25(1) of the 1993 Act under the joint scheme is attributable to each of the participating bodies in the following proportions, that is to sayโ€”

(a) as to Sport England, 83.33 per cent.; and

(b) as to the Arts Council of England, 16.67 per cent.

7. The joint scheme will terminate no later than 31 March 2013.

1993 c. 39 . Schedule 3A was inserted by section 12(3) of, and Schedule 3 to, the National Lottery Act 1998 (c. 22) . Paragraph 2(1) of Schedule 3A was amended (by the addition of sub-paragraph (6)) by paragraph 15(12) of the Schedule to the Scotland Act 1998 (Modification of Functions) Order 1999 (S.I. 1999/1756 ).

Section 25B of, and Schedule 3A to, the National Lottery etc. Act 1993 permit a body which distributes money under section 25(1) of that Act to participate with one or more other such bodies in a joint scheme for the distribution of money under that provision. Section 25B was inserted by section 12(1) of the National Lottery Act 1998.
