The Secretary of State for Health, in exercise of the powers conferred on him by section 126(4) of the National Health Service Act 1977( 1 ) and sections 20(2) and 23 of the Health Act 1999( 2 ) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement and extent

1. β€”(1) These Regulations may be cited as the Commission for Health Improvement (Functions) Amendment Regulations 2000 and shall come into force on 1st April 2000.

(2) These Regulations extend to England only.

Amendment of the Commission for Health Improvement (Functions) Regulations 2000

2. β€”(1)The Commission for Health Improvement (Functions) Regulations 2000( 3 ) are amended in accordance with the following paragraphs of this regulation.

(2) In regulation 20 (restrictions on disclosure of information to the Commission), in paragraph (5), for β€œregulation 18(1)” substitute β€œregulation 17(1)”.

(3) In regulation 22 (exercising functions in relation to health service inquiries), in paragraphs (1) and (2), for β€œfunctions under regulation 2(1)(f) and (g)”, in both places where those words appear, substitute β€œfunction under regulation 2(f)”.

1977 c. 49 ; section 126(4) applies in relation to any power to make orders or regulations conferred by the Health Act 1999 (c. 8) (see section 62(4) of the 1999 Act) and was amended by the National Health Service and Community Care Act 1990 (c. 19) (β€œthe 1999 Act”), section 65(2) and the 1999 Act, Schedule 4, paragraph 37(6).

1999 c. 8 ; see sections 20(7) and 23(6) for the definitions of β€œprescribed”. The functions of the Secretary of State under sections 20(2) and 23 of the 1999 Act and section 126(4) of the National Health Service Act 1977 (β€œthe 1977 Act”) are, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2(a) of, and the entries for the 1977 Act and the 1999 Act in Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672 , as amended by section 66(5) of the 1999 Act.
