The Trafford Park Railway Order 2000

Whereas an application has been made to the Secretary of State for the Environment, Transport and the Regions (“the Secretary of State”), in accordance with the Transport and Works (Applications and Objections Procedure) Rules 1992( 1 ) made under section 6 of the Transport and Works Act 1992( 2 ) (“the Act”) for an Order under sections 1 and 5 of the Act;

And whereas the objections to that application have been withdrawn;

And whereas the Secretary of State has determined to make an Order giving effect to the proposals comprised in the application with modifications which in his opinion do not make any substantial change in the proposals;

And whereas notice of the Secretary of State’s determination was published in the London Gazette on 8th February 2000;

Now, therefore, the Secretary of State in exercise of the powers conferred on him by sections 1 and 5, and of paragraph 8 of Schedule 1 to the Act and all other powers enabling him in that behalf, hereby makes the following Order:—

Citation and commencement

1. This Order may be cited as the Trafford Park Railway Order 2000 and shall come into force on 3rd March 2000.

Interpretation

2. In this Order—

the 1899 Order” means the West Manchester Light Railways Order 1899 ( 3 );

the railway” means the various lengths of railway authorised by the West Manchester Light Railways Order 1899 to 1906 made under the Light Railways Act 1896 ( 4 ), the Trafford Park Act 1904 ( 5 ), the Trafford Park Act 1922 ( 6 ) and the Trafford Park Railway Order 1995 ( 7 ), operated for the carriage of goods and forming the Trafford Park railway network.

Revocation of part of 1899 Order

3. Article 38(1) of the 1899 Order (restrictions on weight on rails) is hereby revoked.

Weight Limit

4. No person shall use upon the railway any engine, carriage or truck bringing a greater weight than 25 tonnes upon the rails by any one pair of wheels.
