In exercise of the powers conferred on the Secretary of State by sections 19 and 42(6) and (7) of the Teaching and Higher Education Act 1998( 1 ) the Secretary of State for Education and Employment hereby makes the following Regulations:
1. These Regulations may be cited as the Education (Induction Arrangements for School Teachers) (Amendment) (England) Regulations 2001 and shall come into force on 15th February 2001.
2. The Education (Induction Arrangements for School Teachers) (England) Regulations 1999( 2 ) shall be amended by the insertion at the end of Schedule 1 of the following paragraphs—
“ 14. A person who on or before 7th May 1999—
(a) was employed as a teacher at a relevant school in England or Wales; and
(b) either—
(i) had successfully completed a course of initial training for teachers in schools at an educational institution in Scotland, or
(ii) was registered as a teacher of primary or secondary education with the General Teaching Council for Scotland.
15. A person who on or before 7th May 1999—
(a) was employed as a teacher at a relevant school in England or Wales; and
(b) either—
(i) had successfully completed a course of initial training for teachers in schools at an educational institution in Northern Ireland, or
(ii) had been awarded confirmation of recognition as a teacher in schools in Northern Ireland by the Northern Ireland Department of Education, that confirmation not having been withdrawn at any time subsequent to the award.
16. A person who is a qualified teacher by virtue of paragraph 10 of Schedule 3 to the Education (Teachers' Qualifications and Health Standards) (England) Regulations 1999 ( 3 ) . ” .

1998 c. 30 ; section 19 is amended by section 139 of the Learning and Skills Act 2000 (c. 21) ; the Secretary of State can exercise the power under section 19 only in relation to England: see article 2 of and Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672 ). For the meaning of “prescribed” and “regulations” see section 43(1).
