The Transport Act 2000 (Commencement No. 3) (Amendment) Order 2001

The Secretary of State for the Environment, Transport and the Regions, in exercise of his powers under sections 275 and 276 of the Transport Act 2000( 1 ), hereby makes the following Order:—

Citation

1. This Order may be cited as the Transport Act 2000 (Commencement No. 3) (Amendment) Order 2001.

Amendment of Part 1 of Schedule 2 to the Transport Act 2000 (Commencement No. 3) Order 2001

2. —(1)Part I of Schedule 2 to the Transport Act 2000 (Commencement No. 3) Order 2001( 2 ) is amended as follows.

(2) After “Sections 212 to 215” insert “(and accordingly Schedule 16)”.

(3) Omit “Section 253”.

(4) After “Sections 232 to 240” insert “(and accordingly Schedule 25)”.

(5) For “Sections 255 to 262 (and accordingly Schedules 29 and 30).” substitute—

Sections 255 and 256.

Sections 261 and 262 (and accordingly Schedule 30). .

(6) For “Sections 264 to 268.” substitute—

Section 264.

Section 266.

Section 268. .

Amendment of Part II of Schedule 3 to the Transport Act 2000 (Commencement No. 3) Order 2001

3. —(1)Part II of Schedule 3 to the Transport Act 2000 (Commencement No. 3) Order 2001 is amended as follows.

(2) for paragraph 2 substitute—

2. Section 111 of the Transport Act 1985(unregistered and unreliable local services: repayment of fuel duty grant) shall continue to apply as respects any proceedings under section 54 of the Public Passenger Vehicles Act 1981 ( 3 ) instigated by a traffic commissioner before 1st February 2001, in respect of the operation of a local service, as if section 158 of and paragraph 22 of Schedule 11 to the Act had not come into force.

3. Notwithstanding their repeal under Part II of Schedule 31 to the Act, sections 89, 90 and 92 of the Transport Act 1985 ( 4 ) (expenditure on public transport services) shall continue to apply as respects invitations to tender issued before 1st February 2001. .
