TERMS AND CONDITIONS OF EMPLOYMENT

The Secretary of State, in exercise of the powers conferred on him by section 219(1) of the Employment Rights Act 1996( 1 ) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1. β€”(1) These Regulations may be cited as the Employment Protection (Continuity of Employment) (Amendment) Regulations 2001 and shall come into force on 21st May 2001.

(2) In these Regulations, β€œthe principal Regulations” means the Employment Protection (Continuity of Employment) Regulations 1996( 2 ).

Amendments to the principal Regulations

2. β€”(1) The principal Regulations shall be amended as follows.

(2) In regulation 2 (application)β€”

(a) at the end of paragraph (c), omit β€œor”;

(b) at the end of paragraph (d), add β€œor”, and

(c) after paragraph (d), add the following paragraphβ€”

β€œ (e) the making of an agreement to submit a dispute to arbitration in accordance with a scheme having effect by virtue of an order under section 212A of the Trade Union and Labour Relations (Consolidation) Act 1992. ”
