The Education (Teachers' Qualifications and Health Standards) (England) (Amendment) Regulations 2001

In exercise of the powers conferred on the Secretary of State by sections 218(1)(a), (2), and 232(5) of the Education Reform Act 1988( 1 ) and having consulted the General Teaching Council for England in accordance with section 218(2AA) of that Act, the Secretary of State for Education and Employment hereby makes the following Regulations:

1. These Regulations may be cited as the Education (Teachers' Qualifications and Health Standards) (England) (Amendment) Regulations 2001 and shall come into force on 26th April 2001.

2. The Education (Teachers' Qualifications and Health Standards) (England) Regulations 1999( 2 ) shall be amended as follows:

(a) in paragraph 4(1) of Schedule 2, the substitution for sub-paragraphs (a) and (b) of “he has successfully completed a programme of professional training for teachers in any country outside the United Kingdom and which is recognised as such a programme of training by the competent authority in that country,”;

(b) in paragraph 4(2) of Schedule 2, the substitution for “two” of “four”;

(c) in paragraph 6(4) of Schedule 2, the substitution for “the training” of “any training”;

(d) for paragraph 7 of Schedule 2 the substitution of the following paragraph—

7. —(1) Subject to sub-paragraph (2), the length of any proposed period of training shall be appropriate to the person’s need for practical teaching experience and training and, in the case of a first recommendation where the person will be employed full-time it shall be not less than three months and not more than one year.

(2) In the case of a person to whom paragraph 6(3)(e)(ii) applies no minimum period of training is required. ;

(e) in paragraph 7(2)(a) of Schedule 3 “either” shall be deleted;

(f) in paragraph 7(2)(a)(i) of Schedule 3 the substitution for “the training” of “any training”;

(g) in paragraph 7(2)(a)(ii) of Schedule 3 after “paragraph (b);” there shall be inserted “or”; and

(h) in paragraph 7(2)(a) of Schedule 3 after sub-paragraph (ii) there shall be added the following sub-paragraph—

(iii) is a graduate teacher to whom paragraph 6(3)(e)(ii) of Schedule 2 applies; .
