The Secretary of State for Health, in exercise of the powers conferred upon him by sections 11(4)(a) and 126(3) and (4) of the National Health Service Act 1977( 1 ) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement, interpretation and extent

1. —(1) This Order may be cited as the National Blood Authority (Establishment and Constitution) Amendment Order 2001 and shall come into force on 29th May 2001.

(2) In this Order

the Order” means the National Blood Authority (Establishment and Constitution) Order 1993( 2 ).

(3) This Order extends to England and Wales.

Constitution of the Authority

2. Article 4 of the Order is amended by substituting, in sub-paragraph (1)(b), for the words “five members” the words “six members” and, in sub-paragraph (1)(d), for the words “four members” the words “five members”.

Functions exercisable in relation to a cross-border body which by their nature cannot specifically be exercised in relation to Wales are exercisable concurrently by the Secretary of State—see article 2(c) of the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672 .
