REPRESENTATION OF THE PEOPLE

The Representation of the People (Scotland) (Amendment) Regulations 2001

Coming into force in accordance with article 1(1)

Whereas a draft of these Regulations has been approved by resolution of each House of Parliament;

And whereas the Secretary of State has, in accordance with section 7(1) and (2)(e) of the Political Parties, Elections and Referendums Act 2000( 1 ) consulted the Electoral Commission about these Regulations;

Now, therefore, the Secretary of State in exercise of the powers conferred on her by the provisions which are specified in the Schedule to these Regulations, and of all other powers enabling her in that behalf, hereby makes the following Regulations:

Citation, commencement and extent

1. —(1) These Regulations may be cited as the Representation of the People (Scotland) (Amendment) Regulations 2001 and shall come into force on the day after the day on which they are made.

(2) These Regulations shall extend to Scotland only.

Amendment of the Representation of the People (Scotland) Regulations 2001

2.The Representation of the People (Scotland) Regulations 2001( 2 ) shall be amended as follows.

3. In regulation 3(1) (interpretation), for the definition of “data” substitute–

“data” means information which is recorded with the intention that it should be processed by means of equipment operating automatically in response to instructions given for that purpose; .

4. In regulation 47 (supply of free copies of register and list of overseas electors on request), after paragraph (1) insert–

(1A) For the purposes of this regulation “register” includes any revised version of the register under section 13(1) and (3) of the Representation of the People Act 1983 ( 3 ) and any notice under sections 13A(2) and 13B(3) of that Act. .

5. In regulation 56(5) (closing date for applications), for sub-paragraphs (i) and (ii) substitute–

Preamble

SCHEDULE ENABLING POWERS

These Regulations are made under the following powers:

(a) sections 53( 4 ), 201(1) and (3)( 5 ) of, and paragraph 10B(1)(a)( 6 ) of Schedule 2 to the Representation of the People Act 1983(“the 1983 Act”);

(b) having regard to the definition of “prescribed” in section 202(1) of the 1983 Act and paragraph 1(2) of Schedule 4 to the Representation of the People Act 2000, paragraph 3(2)(c) of that Schedule.
