The Secretary of State, in exercise of the powers conferred on him by section 26A(3) of the National Assistance Act 1948( 1 ) and of all other powers enabling him in that behalf, hereby makes the following Regulations:
Citation, commencement and extent
1. β(1) These Regulations may be cited as the Residential Accommodation (Relevant Premises, Ordinary Residence and Exemptions) (Amendment) (England) Regulations 2001 and shall come into force on 1st June 2001.
(2) These Regulations extend to England only.
Amendment of the Residential Accommodation (Relevant Premises, Ordinary Residence and Exemptions) Regulations 1993
2. In the Residential Accommodation (Relevant Premises, Ordinary Residence and Exemptions) Regulations 1993( 2 )β
(a) paragraph (2) of regulation 7 (special provisions in respect of persons under pensionable age) shall be omitted;
(b) paragraph (2) of regulation 9 (special provisions in respect of persons over pensionable age) shall be omitted.

1948 c. 29 ; section 26A was inserted by section 43 of the National Health Service and Community Care Act 1990 (c. 19) (βthe 1990 Actβ). Section 43 of the 1990 Act, and consequently section 26A of the National Assistance Act 1948, does not extend to Scotland. The powers of the Secretary of State to make regulations under section 26A have been devolved in relation to Wales by article 2 of, and Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 ( S.I. 1999/672 ).
