In exercise of the powers conferred on the Secretary of State by sections 79F(1)(b) and (2)(b) and 104(4) of, and paragraphs 6(4) and 7 of Schedule 9A to, the Children Act 1989( 1 ), the Secretary of State for Education and Employment hereby makes the following Regulations:
Citation and commencement
1. —(1) These Regulations may be cited as the Child Minding and Day Care (Registration and Annual Fees) Regulations 2001 and shall come into force on 2nd July 2001.
(2) These Regulations apply only in relation to England.
Interpretation
2. In these Regulations “the Act” means the Children Act 1989.
Registration
3. —(1) The prescribed fee for the purposes of section 79F(1)(b) of the Act (child minding) is £14.00.
(2) The prescribed fee for the purposes of section 79F(2)(b) of the Act (day care) is—
(a) £121.00, where the applicant provides or is to provide day care for a continuous period of four hours or more in any day;
(b) £14.00, where the applicant does not provide or is not to provide day care for a continuous period of four hours or more in any day.
Annual fees
4. —(1) The following fees are prescribed for the purposes of paragraph 7 of Schedule 9A to the Act (annual fee)—
(a) £11.00, in the case of a child minder;
(b) £94.00, in the case of a provider of day care for a continuous period of four hours or more in any day;
(c) £11.00, in the case of a provider of day care who does not provide day care for a continuous period of four hours or more in any day.
(2) The fee is payable annually on the anniversary of registration for child minding or providing day care.

5. The prescribed fee for the issue of a copy certificate of registration for child minding or providing day care under paragraph 6(4) of Schedule 9A to the Act is £5.

1989 c. 41 . Section 79F was inserted by section 79(1) of the Care Standards Act 2000 (c. 14) and Schedule 9A was inserted by Schedule 3 to that Act. For the meaning of “prescribed” see section 105(1) of the 1989 Act and for the meaning of “regulations” see section 79B(7) of that Act (inserted by section 79(1) of the Care Standards Act 2000).
