Whereas the Secretary of State has published in the L_ndon, Edinburgh and Belfast Gazettes the notice required by section 6(2) of the Wireless Telegraphy Act 1998(“the 1998 Act”)( 1 ) and has considered the representations made to him within the time specified in that notice;

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 1 of the 1998 Act and of all other powers enabling him in that behalf, and having regard to the matters specified in section 2(2) of the 1998 Act, hereby makes the following Regulations—

1. These Regulations may be cited as the Wireless Telegraphy (Licence Charges) (Amendment) Regulations 2001 and shall come into force on 19th July 2001 other than regulation 2(d)(vii) and Schedule 2 to the extent that such provisions relate to the Permanent Earth Station Licence and which shall come into force on 30th October 2001.

2. The Wireless Telegraphy (Licence Charges) Regulations 1999 (“the Principal Regulations”)( 2 ) are hereby amended as follows—

(a) in regulation 3(2), “and a Scanning Telemetry Licence” shall be inserted after “a National and Regional Private Business Radio Licence” in the definition of “national channel”;

(b) in regulation 3(5)—

(i) “and” shall be deleted before, and “, a UK Wireless Microphone (Annual) Licence and a UK Wireless Microphone (Biennial) Licence” shall be inserted after, the words “a Programme Making and Special Events Link Licence”; and

(ii) sub-paragraph (b) shall be deleted;

(c) in regulation 5(3), “Ship Fixed Radio” shall be substituted for “Ship Radio” in sub-paragraph (xi) and the following provision shall be inserted after that sub-paragraph—

(xia) Ship Portable Radio; ;

(d) in Schedule 2—

(i) under the heading “ Amateur and Citizens' Band ”, the following words shall be substituted for the words in the third column relating to the Amateur Radio and Citizens' Band Radio Licences—

(ii) under the heading “ Fixed Links ”—

(aa) “£720”, “£885”, “£1,030” and “£1,155” shall be substituted respectively for “£540”, “£664”, “£773” and “£866” in the third column relating to the Point to Multi-point Services 31.00 to 31.80 GHz Licence; and

(bb) the following shall be inserted at the end of the provisions relating to the Scanning Telemetry Licence—

The prescribed sum in respect of the issue or renewal of the licence and in respect of the prescribed time: The prescribed time:

(iii) under the heading “ Maritime ”—

(aa) the following licence classes shall be inserted after the Coastal Station Radio Licence—

Coastal Station Radio (Fixed Platform) £250 Yearly
Coastal Station Radio (Training School) £50 Yearly ;

(bb) the following licence class shall be inserted after the Maritime Radio (Navigational Aid and Radar) Licence—

Maritime Radio (Suppliers and Demonstration) £50 Yearly ;

(cc) the Ship Radio Licence shall be renamed the Ship Fixed Radio Licence; and

(dd) the following licence class shall be inserted after the Ship Fixed Radio Licence—

Ship Portable Radio £15 Yearly ;

(iv) under the heading “ Private Business Radio ”, “£1,500” shall be substituted for “£1,000” in the second column relating to the Private Mobile Radio Road Construction Licence;

(v) under the heading “ Programme Making and Special Events ”—

(aa) “£55” shall be substituted for “£50” in lines 2 and 13 of the third column relating to the Programme Making and Special Events Fixed Site Licence;

(bb) “£55” shall be substituted for “£50” in lines 2 and 120 of, and lines 88 to 107 shall be deleted in, the third column relating to the Programme Making and Special Events Link Licence;

(cc) “£55” shall be substituted for “£50” in lines 2 and 29 of, and lines 12, 15, 19, 26 and 27 shall be deleted in, the third column relating to the Programme Making and Special Events Low Power Licence; and

(dd) the following licence classes shall be inserted after the Programme Making and Special Events Low Power Licence—

UK Wireless Microphone (Annual) £75 per shared UK multi-channel or wideband channel Yearly
UK Wireless Microphone (Biennial) £135 per shared UK multi-channel or wideband channel Two-yearly ;

(vi) under the heading “ Public Telecommunications Networks ”—

(aa) “£32” and “£260” shall be substituted respectively for “£25” and “£200” in the third column relating to the Channel Islands and Isle of Man Cellular Telephone Operator Licence;

(bb) “£1,400” and “£750” shall be substituted respectively for “£1,200” and “£675” in the third column relating to the Common Base Station Operator Licence;

(cc) “£8,750”, “£7,500”, “£6,000”, “£6,000”, “£7,500”, “£3,840”, “£1,000”, “£17,820”, “£142,560”, “£110,880” and “£110,880” shall be substituted respectively for “£7,600”, “£6,000”, “£4,800”, “£4,800”, “£6,000”, “£2,640”, “£920”, “£10,000”, “£80,000”, “£75,000” and “£70,000” in the third column relating to the Public Mobile Operator Licence; and

(dd) “Fixed Wireless Access” shall be substituted for “Radio Fixed Access Operator” in the first column;

(vii) under the heading “ Satellite Services ”, the following shall be substituted for the provisions relating to the Permanent Earth Station Licence and the Transportable Earth Station Licence—

Permanent Earth Station For each site (the area contained within a circle of a radius of 500 metres centred on a point defined by the licensee), the appropriate sum calculated in accordance with the algorithm set out in Part II of Schedule 7 and taking into account the appropriate Modifier Value referred to in the table set out in Part III of that Schedule (which is based on the exclusivity of the radio frequency spectrum occupied by the licensee) Yearly
Transportable Earth Station For each station operating in the 14.0 to 14.5 GHz band, the appropriate sum calculated in accordance with the algorithm set out in Part II of Schedule 7 and taking into account the appropriate Modifier Value referred to in the table set out in Part IV of that Schedule (which is based on the exclusivity of the radio frequency spectrum occupied by the licensee) Yearly ; and

(viii) under the heading “ Technology Development ”, the following words shall be substituted for the words in the third column relating to the Unspecified Temporary Radio Use Licence—
