The Social Security Act 1998 (Commencement No. 13) Order 2001

26th June 2001

The Secretary of State for Work and Pensions, in exercise of the powers conferred upon him by sections 79(3), (4) and 87(2) of the Social Security Act 1998( 1 ) and all other powers enabling him in that behalf, hereby makes the following Order:

Citation and interpretation

1. —(1) This Order may be cited as the Social Security Act 1998 (Commencement No. 13) Order 2001.

(2) In this Order the “1998 Act” means the Social Security Act 1998 .

Appointed day

2. The appointed day is 2nd July 2001 for the coming into force of—

(a) paragraphs 79(2) and 80 of Schedule 7 to, and in so far as it relates to those paragraphs, section 86(1) of the 1998 Act;

(b) in so far as it relates to housing benefit, paragraph 79(1)(b) of Schedule 7 to the 1998 Act and section 86(1) of that Act in so far as it relates to that paragraph; and

(c) Schedule 8 to, and section 86(2) of the 1998 Act in respect of the repeal of—

(i) section 6(1)(n) and (o) (council tax benefit) and

(ii) section 5(1)(n) and (o) and (4) (housing benefit)

of the Social Security Administration Act 1992( 2 ).

See article 2(2) — this provides that provisions specified in Schedule 1 of that Order shall not apply to housing benefit, council tax benefit or decisions to which article 4(6) of the Social Security Contributions (Transfer of Functions, etc. ) Act 1999 (Commencement No. 1 and Transitional Provisions) Order 1999 applies.
