The Secretary of State for Work and Pensions, in exercise of the powers conferred upon him by section 122(1) and (6) of the Housing Act 1996( 1 ) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and extent

1. —(1) This Order may be cited as the Rent Officers (Housing Benefit Functions) (Amendment) (No.2) Order 2001 and shall come into force on 2nd July 2001.

(2) This Order extends to England and Wales only.

Amendment to the Rent Officers (Housing Benefit Functions) Order 1997

2. —(1)The Rent Officers (Housing Benefit Functions) Order 1997( 2 ) shall be amended in accordance with this article.

(2) In article 3A, the words “the day before” shall be omitted.

(3) In paragraph 4(2)(b)(iii) of Schedule 1 to that Order, for the words “kitchen or toilet”, in both places where those words occur, there shall be substituted the words “kitchen, toilet, bathroom and room suitable for living in”.
