The Secretary of State, being satisfied that the site identified in article 2 of this Order is, or may prove to be, the site of a vessel lying wrecked on or in the sea bed and that, on account of the historical, archaeological and artistic importance of the vessel and of any objects contained or formerly contained in it which may be lying on the sea bed in or near the wreck, the site ought to be protected from unauthorised interference, in exercise of the powers conferred on her by section 1(1), (2) and (4) of the Protection of Wrecks Act 1973( 1 ), and after consulting with the persons referred to in section 1(4) of that Act, hereby makes the following Order—
Citation and commencement
1. This Order may be cited as the Protection of Wrecks (Designation) Order 2001 and shall come into force on 5th July 2001.
Identification of site and designation of restricted area
2. —(1) The site in respect of which this Order is made is hereby identified as the site where part of HMS Colossus lies wrecked on the seabed at Latitude 49° 55' . 471 North, Longitude 006° 20' . 505 West.
(2)The area within a distance of 300 metres of Latitude 49° 55' . 471 North, Longitude 006° 20' . 505 West, but excluding any part of that area which lies above high water mark of ordinary spring tides, shall be restricted area for the purposes of the Protection of Wrecks Act 1973.
