The Secretary of State, in exercise of the powers conferred upon her by sections 107, 112(1), 113 and 114 of the Scotland Act 1998( 1 ) and of all other powers enabling her in that behalf, and being of the view that paragraph 24 of schedule 3 to the Regulation of Care (Scotland) Act 2001( 2 ) is not, or may not be, within the legislative competence of the Scottish Parliament, hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Scotland Act 1998 (Regulation of Care (Scotland) Act 2001) Order 2001 and shall come into force on 3rd August 2001.

Regulation of Care (Scotland) Act 2001

2.Paragraph 24 of schedule 3 to the Regulation of Care (Scotland) Act 2001 is hereby repealed.
