The Secretary of State, in exercise of the powers conferred on him by sections 7(2) and (11) of the Data Protection Act 1998( 1 ) (having regard to the definitions of “prescribed” and “the prescribed maximum” (in section 7(10) and 67(2) of that Act)) and having consulted the Information Commissioner in accordance with section 67(3) of that Act( 2 ), hereby makes the following Regulations—

Citation and commencement

1. These Regulations may be cited as the Data Protection (Subject Access) (Fees and Miscellaneous Provisions) (Amendment) Regulations 2001 and shall come into force on 23rd October 2001.

Amendment of regulation 6 of the Data Protection (Subject Access) (Fees and Miscellaneous Provisions) Regulations 2000( 3 )

2. —(1) The Data Protection (Subject Access) (Fees and Miscellaneous Provisions) Regulations 2000 shall be amended as follows.

(2) In the heading to regulation 6 (certain subject access requests in respect of health records) omit “—transitional provisions”.

(3) In regulation 6(1)—

(a) in sub-paragraph (a), after “Act,” add “and”;

(b) omit
