Title, commencement and extent
1. —(1) This Scheme may be cited as the Food Industry Development (Amendment) (England) Scheme 2001 and shall come into force on 29th October 2001.
(2) This Scheme applies to England.
Amendment of the Food Industry Development Scheme 1997
2. The Food Industry Development Scheme 1997( 3 ) (hereinafter referred to as “the Scheme”) shall have effect subject to the amendments contained in paragraphs 3 and 4.
3. In paragraph 5 (eligibility for consideration for the payment of a grant under the Scheme), at the end of sub-paragraph (2) there shall be inserted the words “and that the applicant falls within any class or classes to which the Minister has restricted applications under paragraph 6(2A)”.
4. In paragraph 6 (applications for grants under the Scheme), after sub-paragraph (2) there shall be inserted the following sub-paragraph—
“ (2A) An invitation by the appropriate Minister for applications for the payment of a grant under this Scheme may be restricted to such class or classes of person as that Minister shall determine. ” .

By virtue, in relation to England, of S.I. 1999/3141 : “the Ministers” is defined in section 50(9) of the Agriculture Act 1993 as the Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales acting jointly; that power was severed and transferred, in relation to Scotland, to the Scottish Ministers by section 53 of the Scotland Act 1998 (c. 46) and, in relation to Wales, to the National Assembly for Wales by article 2(a) of, and Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672 ).
