The Secretary of State for Health, in exercise of the powers conferred on him by sections 11(4) and 126(3) and (4) of the National Health Service Act 1977( 1 ) and all other powers enabling him in that behalf, hereby makes the following Order:
Citation, commencement and interpretation
1. β(1) This Order may be cited as the Family Health Services Appeal Authority (Change of Name) Order 2001 and shall come into force on 24th November 2001.
(2) In this Orderβ
βthe Establishment Orderβ means the Family Health Services Appeal Authority (Establishment and Constitution) Order( 2 );
βthe Regulationsβ means the Family Health Services Appeal Authority Regulations( 3 );
βthe Health Service Commissioner Orderβ means the Health Service Commissioner (Family Health Services Appeal Authority) Order( 4 );
βthe Special Health Authorityβ means the Special Health Authority established by article 2 of the Establishment Order.
Change of name of the Special Health Authority
2. The name by which the Special Health Authority is known is changed to the Family Health Services Appeal Authority (Special Health Authority).
Consequential and transitional provisions
3. β(1) In the Establishment Order, the Regulations or the Health Service Commissioner Order for the name βFamily Health Services Appeal Authorityβ wherever it is used the name βFamily Health Services Appeal Authority (Special Health Authority)β shall be substituted.
(2) The change of name under this Order shall notβ
(a) affect any right or obligation of any person, or
(b) be taken as invalidating any instrument (whether made before, on or after the day on which this Order comes into force) which refers to the Special Health Authority by its previous name and all instruments and other documents which refer to it under its previous name shall be construed as referring to it under its new name.

1977 c. 49 , section 11 was amended by paragraph 31 of Schedule 1 to the Health Services Act 1980 (c. 53) , by Schedule 10 to the National Health Services and Community Care Act 1990 (c. 19) (βthe 1990 Actβ), by paragraph 2 of Schedule 1 to the Health Authorities Act 1995 (c. 17) (βthe 1995 Actβ) and by paragraph 6 of Schedule 4 to the Health Act 1999 (c. 8) (βthe 1999 Actβ); section 126(3) and (4) was amended by the 1990 Act, section 65(2), by the 1995 Act, Schedule 1, paragraph 57, by the National Health Service (Primary Care) Act 1997 (c. 46) , Schedule 2, paragraph 27 and by the 1999 Act, Schedule 4, paragraph 37. The functions of the Secretary of State under these provisions are, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2(a) of the National Assembly for Wales (Transfer of Functions) Order 1999, S.I.1999/672 as amended by section 66(5) of the 1999 Act.
