The Lord Chancellor, in exercise of the powers conferred on him by section 19 of the Law of Property (Miscellaneous Provisions) Act 1994( 1 ), makes the following Regulations:

Citation, commencement and interpretation

1. —(1) These Regulations may be cited as the Public Trustee (Notices Affecting Land) (Title on Death) (Amendment) Regulations 2001 and shall come into force on 1st January 2002.

(2) In these Regulations a reference to a regulation or form by number alone shall be construed respectively as a reference to the regulation so numbered in, or the form so numbered in the Schedule to, the Public Trustee (Notices Affecting Land) (Title on Death) Regulations 1995( 2 ).

Transitional provisions

2. —(1) In this Regulation—

(a) “old Form NL(1)” or, as the case may be, “old Form NL(2)” means Form NL(1) or Form NL(2) as it stood immediately before these Regulations came into force;

(b) “new Form NL(1)” or, as the case may be, “new Form NL(2)” means Form NL(1) or Form NL(2) as it is amended by these Regulations.

(2) An application to register as mentioned in regulation 3(1)(b) which is received by the Public Trustee on or after 1st January 2002 but before 1st April 2002 may be in either old Form NL(1) or new Form NL(1).

(3) An application to search as mentioned in regulation 4(1) which is received by the Public Trustee on or after 1st January 2002 but before 1st April 2002 may be in either old Form NL(2) or new Form NL(2).

Amendments to forms in Public Trustee (Notices Affecting Land) (Title on Death) Regulations1995

3. —(1) In Form NL(1)—

(a) in the heading, for “PUBLIC TRUST OFFICE” there shall be substituted “THE PUBLIC TRUSTEE”, and “AN EXECUTIVE AGENCY” shall be deleted;

(b) in the box containing wording beginning “The fee of”, for “Public Trust Office” there shall be substituted “Public Trustee”;

(c) in paragraph 2 of the Explanatory Notes, for “Public Trust Office” there shall be substituted ``office of the Public Trustee''.

(2) In Form NL(2)—

(a) in the heading, for “PUBLIC TRUST OFFICE” there shall be substituted “THE PUBLIC TRUSTEE”, and “AN EXECUTIVE AGENCY” shall be deleted;

(b) in the box containing wording beginning “The fee of”, for “Public Trust Office” there shall be substituted “Public Trustee”;

(c) in the box headed “Public Trust Office”, for “Public Trust Office” there shall be substituted “Public Trustee”;

(d) in paragraph 2 of the Explanatory Notes, for “Public Trust Office” there shall be substituted “office of the Public Trustee”.
