The Non-Domestic Rating (Designation of Rural Areas) (England) Order 2001

The Secretary of State for Transport, Local Government and the Regions, in exercise of the powers conferred upon him by section 42A(3)(c) of the Local Government Finance Act 1988( 1 ), and of all other powers enabling him in that behalf, hereby makes the following Order:—

Citation, commencement, extent and interpretation

1. —(1) This Order, which extends to England only, may be cited as the Non-Domestic Rating (Designation of Rural Areas) (England) Order 2001 and shall come into force on 31st December 2001.

(2) In this Order:

the map” means the maps each entitled “Map referred to in the Non-Domestic Rating (Designation of Rural Areas) (England) Order 2001 ”, of which prints, signed by a member of the Senior Civil Service in the Department for Transport, Local Government and the Regions, are deposited and available for inspection at the offices of the Secretary of State for Transport, Local Government and the Regions; and

urban areas” means—

(i)

the areas of the local authorities specified in the Schedule to this Order; and

(ii)

the areas shown cross-hatched on the map bounded externally by the outer edge of a black line,

excluding, in each case, any part or parts of the areas which are designated as rural areas under—

(a)

article 2 of the Non-Domestic Rating (Rural Settlements) (England) Order 1997( 2 );

(b)

article 2 of the Non-Domestic Rating (Rural Settlements) (England) Order 1998( 3 );

(c)

article 2 of the Non-Domestic Rating (Rural Settlements) (England) (No. 2) Order 1998( 4 ); or

(d)

article 2 of the Non-Domestic Rating (Rural Settlements) (England) Order 1999( 5 ).

Designation of rural areas

2. There is designated as a rural area for the purposes of section 42A (rural settlement list) of the Local Government Finance Act 1988 all of England outside the urban areas.
