The Secretary of State, being a Minister designated( 1 ) for the purposes of section 2(2) of the European Communities Act 1972( 2 ) in relation to measures relating to noise emission in the environment by equipment for use outdoors, in exercise of the powers conferred on her by that section and of all her other enabling powers, hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Noise Emission in the Environment by Equipment for use Outdoors (Amendment) Regulations 2001 and shall come into force on 3rd January 2002.

Amendments to the Noise Emission in the Environment by Equipment for use Outdoors Regulations 2001

2. —(1) In regulation 3(2) of the Noise Emission in the Environment by Equipment for use Outdoors Regulations 2001( 3 ) after the words “as further defined in Schedule 4”, there shall be added “in respect of the requirements relating to the sound power level of equipment.”.

(2) In regulation 19(2) there shall be deleted the words “(1) or (2)”.

(3) In Schedule 13, paragraph 1(1) for the words “Department of the Environment, Transport and the Regions” there shall be substituted “Department of Transport, Local Government and the Regions”.

(4) In Schedule 13, paragraph 7(5), for the word “regulation” there shall be substituted “paragraph”.
