By the Lords of Her Majesty’s Most Honourable Privy Council

Their Lordships, in exercise of the powers conferred on them by article 54(2) of the Nursing and Midwifery Order 2001( 1 ), and of all other powers enabling them in that behalf, hereby make the following Order:

Citation, commencement and interpretation

1. —(1) This Order may be cited as the Nursing and Midwifery Order 2001 (Transitional Provisions) Order 2002 and shall come into force—

(a) for the purposes of article 2(a)(ii), on the date specified for the coming into force of article 27(a) of the Nursing and Midwifery Order 2001;

(b) for the purposes of article 2(c), on the date specified for the coming into force of article 36 of the Nursing and Midwifery Order 2001;

(c) for the purposes of the remaining provisions, on 1st April 2002.

(2) In this Order

Council” means the Nursing and Midwifery Council established by article 3 of the Nursing and Midwifery Order 2001 ; and

the Order” means the Nursing and Midwifery Order 2001 .

Transitional Provisions

2. Until a register is established under article 5(1) of the Order

(a) the expression “registrant” where it appears in the following provisions shall mean “a person registered on the register maintained by the Council pursuant to paragraph 10 of Schedule 2 to the Order”—

(i) article 3(4), (5), (13) and (14),

(ii) article 27(a), and

(iii) article 47(3);

(b) in Schedule 1—

(i) paragraph 8(2)(b) shall apply as if the reference to “registrant member” were a reference to “practitioner member” and as if the reference to “national constituencies” were to “UK countries” and the reference to “national constituency” were omitted,

(ii) paragraph 8(2)(e) shall apply as if the reference to an order made by a Practice Committee were a reference to a determination made under paragraph 16 or 17 of Schedule 2;

(c) a person registered on the register maintained pursuant to paragraph 10 of Schedule 2 to the Order may be appointed as a registrant assessor under article 36 of the Order.
