The Secretary of State, in exercise of the powers conferred upon him by section 3(1) of the Criminal Justice and Police Act 2001( 1 ), hereby makes the following Order:
1. This Order may be cited as the Penalties for Disorderly Behaviour (Amount of Penalty) Order 2002 and shall come into force on 8th August 2002.
2. The amount of the penalty payable in respect of a penalty offence( 2 ) is—
(a) in the case of an offence falling under Part I of the Schedule to this Order, £80; or
(b) in the case of an offence falling under Part II of that Schedule, £40.

“Penalty offence” is defined in section 1(1) of the Criminal Justice and Police Act 2001.
