Whereas the Secretary of State for Education and Skills has received a proposal from the Learning and Skills Council for England, made in accordance with section 51 of the Further and Higher Education Act 1992( 1 ) (βthe Actβ), for the dissolution under section 27 of the Act of the further education corporation known as East Yorkshire College of Further Education, Bridlington( 2 ).
Now therefore, in exercise of the powers conferred on her by section 27 of the Act, the Secretary of State, after consulting the corporation and with the consent of the further education corporation known as Beverley College of Further Education( 3 ), hereby makes the following Order:
1. This Order may be cited as the East Yorkshire College of Further Education, Bridlington (Dissolution) Order 2002 and shall come into force on 1st March 2002.
2. On 1st March 2002 East Yorkshire College of Further Education, Bridlington shall be dissolved and all of its property, rights and liabilities shall be transferred to Beverley College of Further Education being a body corporate established for purposes which include the provision of educational facilities or services.
3. Section 26(2), (3) and (4) of the Act shall apply to any person employed by the corporation immediately before 1st March 2002 as if the references in that sectionβ
(a) to a person to whom that section applies were to a person so employed;
(b) to the operative date were to 1st March 2002;
(c) to the transferor were to East Yorkshire College of Further Education, Bridlington and
(d) to the corporation were to Beverley College of Further Education.
