The Secretary of State for Transport, in exercise of the powers conferred by sections 52(1) and 60(1)(e) and (1A) of the Public Passenger Vehicles Act 1981( 1 ), and after consultation with representative organisations in accordance with section 61(2) of that Act, hereby makes the following Regulations:—
Citation and commencement
1. These Regulations may be cited as the Public Service Vehicles (Operators' Licences) (Fees) (Amendment) Regulations 2002 and shall come into force on 1st November 2002.
Amendment to fees
2. —(1)The Public Passenger Vehicles (Operators' Licences) (Fees) Regulations 1995( 2 ) (“the principal Regulations”) are amended as provided in paragraphs (2) and (3) below.
(2) For regulation 3(4)(b) there is substituted—
“ (b) in relation to fee number (vi) in column 1 a fee shall be paid by that licence holder, either annually or in respect of a period of less than a year, in accordance with the prescribed stipulations in column 5 ” .
(3) For the Schedule there is substituted the Schedule to these Regulations.
Transitional provisions
3. —(1) Where a decision has been made before 1st November 2002 on an application for the grant of a standard or restricted licence under section 14(1) of the Public Passenger Vehicles Act 1981( 3 ), the fee prescribed by the principal Regulations applies notwithstanding that the period of 21 days within which it is payable has not expired before that date.
(2) Notwithstanding that the fee for the continuation in force of an existing standard or restricted licence may, under the provisions of the principal Regulations, be paid before the expiry of the relevant period of 5 years specified therein, where that period expires on or after 1st November 2002, the fee payable shall be the fee prescribed in these Regulations.

1981 c. 14 . Section 52(1) was amended by the Transport Act 1985 (c. 67 , in these footnotes called “the 1985 Act”), Schedule 2, Part II, paragraph 4(14). In section 60, subsection 1(e) was substituted by the Deregulation and Contracting Out Act 1994 (c. 40 , in these footnotes called “the 1994 Act”), section 66(5), and subsection (1A) was inserted by the 1985 Act, section 134(2).

Section 14 was amended by the 1994 Act, section 60 and Schedule 14, paragraphs 2 and 3 and by the 1985 Act, Schedule 2, Part II, paragraphs 4(5) and 5.

Section 16 of the 1981 Act was amended by the 1994 Act, Schedule 14, paragraph 4 and by the 1985 Act, Schedule 2, Part II, paragraph 4(7). Section 18 was amended by the 1994 Act, section 63 and Schedule 14, paragraph 6.
