The Secretary of State for Transport, in exercise of the powers conferred upon him by sections 49(2), 143(4) and 151(5) of the Railways Act 1993( 1 ), hereby makes the following Order:

1. This Order may be cited as the Railways (Heathrow Express) (Exemptions) (Amendment) Order 2002 and shall come into force on 1st December 2002.

2. Article 5 of the Railways (Heathrow Express) (Exemptions) Order 1994( 2 ) shall be amended by inserting at the end the following paragraph—

(3) Every railway passenger service provided—

(a) on any railway line comprised in any such network as is mentioned in article 2(1)(b) above, or

(b) to or from any such station as is mentioned in article 2(1)(d) above,

is a service in relation to which section 37 of the 1993 Act (proposals to discontinue non-franchised passenger services) is not to have effect. .
