The Learning and Skills Act 2000 (Commencement No. 4) and Transitional Provisions Order 2002

In exercise of the powers conferred by sections 152(6) and 154(1) and (3) of the Learning and Skills Act 2000( 1 ), the Secretary of State for Education and Skills hereby makes the following Order:

Citation and interpretation

1. β€”(1) This Order may be cited as the Learning and Skills Act 2000 (Commencement No. 4) and Transitional Provisions Order 2002.

(2) In this Order β€œthe Act” means the Learning and Skills Act 2000.

Provisions coming into force

2. β€”(1) Section 7 of the Act shall come into force on 1st March 2002.

(2) The following provisions of the Act shall come into force on 1st April 2002β€”

(a) section 103(2) and (3) insofar as it relates to England and to the extent that it is not already in force;

(b) section 140(1) and (2) insofar as it relates to England.

(3) The following provisions of the Act shall come into force on 1st August 2002β€”

(a) section 97 insofar as it relates to England;

(b) section 110(2), (4) and (5) insofar as it relates to England and to the extent that it is not already in force.

Transitional Provisions

3. β€”(1) Despite the provisions of article 2(2) above, the duty contained in section 140(2) of the Act shall not apply in relation to any person if a Connexions partnership has not been established for the area of the local education authority in which the person undertakes his last year of compulsory schooling.

(2) For the purposes of paragraph (1)β€”

(a) a β€œConnexions partnership” means a body known by that name whose functions include the provision of services such as are described in section 114 of the Act pursuant to arrangements made by the Secretary of State; and

(b) a Connexions partnership is β€œestablished” on the first occasion on which financial assistance is given to the body pursuant to section 114(3) of the Act.
