The Functions of Traffic Wardens (Amendment) Order 2002

Whereas a draft of this Order has been laid before Parliament and has been approved by resolution of each House of Parliament:
Now, therefore, the Secretary of State, in exercise of the powers conferred upon him by sections 95(5) and 96 of the Road Traffic Regulation Act 1984( 1 ), hereby makes the following Order:
1. โ(1) This Order may be cited as the Functions of Traffic Wardens (Amendment) Order 2002 and shall come into force on 2nd December 2002.
(2) This Order shall not extend to Scotland.
(3) In this Order, โthe 1970 Orderโ means the Functions of Traffic Wardens Order 1970( 2 ).
2. In article 3(2) of the 1970 Order, after sub-paragraph (g), insertโ
โ (h) section 67(3) of the Road Traffic Act 1988 ( 3 ) (power to stop vehicles for testing);
(i) section 163 of the Road Traffic Act 1988 (power to stop vehicles). โ .
3. โ(1) The Schedule to the 1970 Order shall be amended as follows.
(2) After paragraph 5, insertโ
โ 5A. Traffic wardens may be employed to stop vehicles for the purposes of a test under subsection (1) of section 67 of the Road Traffic Act 1988 (testing of conditions of vehicles on roads).
5B. Traffic wardens may be employed to escort vehicles or trailers carrying loads of exceptional dimensions the use of which is authorised by an order made by the Secretary of State under section 44(1)(d) of the Road Traffic Act 1988. โ .
(3) Paragraph 6(2) shall be omitted.
