The First Secretary of State, in exercise of the powers conferred by section 143(1) and (2) of, and paragraphs 4 and 6 of Schedule 8 to, the Local Government Finance Act 1988( 1 ) and all other powers enabling him in that behalf, hereby makes the following Regulations:
Citation and commencement
1. These Regulations may be cited as the Non-Domestic Rating Contributions (England) (Amendment) Regulations 2002 and shall come into force on 31st December 2002.
Amendment of the 1992 Regulations
2. Schedules 1 and 2 to the Non-Domestic Rating Contributions (England) Regulations 1992( 2 ) are amended as follows in relation to financial years beginning on or after 1st April 2003.
Rules for the calculation of non-domestic rating contributions
3. In Schedule 1—
(a) in paragraph 1(4), for “2002” there is substituted “2003”;
(b) in paragraph 4(4), for “2002” there is substituted “2003”;
(c) for Part II there is substituted—

Assumptions relating to provisional amounts
4. In relation to financial years beginning on or after 1st April 2003, in Schedule 2—
(a) for paragraph 2(12) there is substituted the following—
“ (12) It shall be assumed that the amount calculated for the authority in accordance with the assumptions prescribed in sub-paragraphs (1) to (11) above is the total of the amount so calculated multiplied by 0.961. ” ;
(b) for the table in paragraph 8(1) there is substituted the following—

1988 c. 41 . Sections 140 and 143 are amended by paragraphs 69 and 72 of Schedule 5 to the Local Government and Housing Act 1989 (c. 42) (“the 1989 Act”), and paragraphs 4 and 6 of Schedule 8 are amended by paragraph 42 of Schedule 5 to the 1989 Act and by paragraph 6 of Schedule 10 and paragraph 86 of Schedule 13 to the Local Government Finance Act 1992 (c. 14) . These powers are devolved, in relation to Wales, to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 ( S.I. 1999/672 ).
