The Secretary of State for Education and Skills, in exercise of the powers conferred on the Secretary of State by sections 22, 42(6) and 43(1) of the Teaching and Higher Education Act 1998( 1 ), hereby makes the following Regulations:—
Citation and commencement
1. These Regulations may be cited as the Education (Student Support) (Amendment) (No. 3) Regulations 2002 and shall come into force on 3rd January 2003.
2. The Education (Student Support) Regulations 2002( 2 ) shall be amended in accordance with these Regulations.
Amendments to the Regulations
3. —(1)Regulation 15 shall be amended as follows—
(2) In paragraph (13)—
(a) at the end of sub-paragraph (f) for “of that Act,” substitute “of that Act; and;”; and
(b) after sub-paragraph (f) insert—
“ (g) any child tax credit to which he is entitled under Part I of the Tax Credits Act 2002 ( 3 ) . ” .
4. —(1)Regulation 17 shall be amended as follows.
(2) In paragraphs (1) and (3) for “a city technology college or a city college for the technology of the arts or a city academy” substitute “an Academy ( 4 )”.
5. —(1) Schedule 3 shall be amended as follows.
(2) In paragraph 1(1) for sub-paragraph (r) substitute—
“ (r) income support or working families' tax credit under Part VII of the Social Security Contributions and Benefits Act 1992 or any child tax credit or working tax credit under Part I of the Tax Credits Act 2002; ” .

1996 c. 56 ; references to city colleges established pursuant to section 482 of the Education Act 1996 (c. 56) have as a result of amendments made to that section by section 65 of the Education Act 2002 (c. 32) been replaced by references to Academies.
