The Gloucestershire County Council (Two Mile Bend Bridge) Scheme 2001 Confirmation Instrument 2002

Coming into force in accordance with article 1

The Secretary of State for Transport makes this Instrument in exercise of powers conferred by section 106(3) of the Highways Act 1980( 1 ) and now vested in him ( 2 ) and of all other powers enabling him in that behalf:

1. This Instrument may be cited as The Gloucestershire County Council (Two Mile Bend Bridge) Scheme 2001 Confirmation Instrument 2002 and shall come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

2. The Gloucestershire County Council (Two Mile Bend Bridge) Scheme 2001 (“the Scheme”) is hereby confirmed with modifications.

3. The Scheme as confirmed is set out in the Schedule hereto (including the plan) and copies of the Scheme with its accompanying plan as modified are deposited at the offices of the Department for Transport, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA, and at the offices of Gloucestershire County Council at Shire Hall, Westgate Street, Gloucester.

THE SCHEDULE THE GLOUCESTERSHIRE COUNTY COUNCIL (TWO MILE BEND BRIDGE) SCHEME 2001

The Gloucestershire County Council (hereinafter referred to as “the Council”) make this scheme in exercise of their powers under Section 106(3) of the Highways Act 1980 and all other powers enabling them in that behalf—

1. The Council are authorised to construct over the navigable waterways of the Gloucester and Sharpness Canal the swing bridge (“the bridge”) specified in the schedule to the scheme as part of the highway which they are proposing to construct between Cole Avenue junction (which forms the junction of the A430, B4008, A38 and unclassified road 482540) and Hempsted Lane (3/8012) in the City of Gloucester in the said County.

2. The bridge control cabin will be manned and operated upon request for all craft with the exception of the morning and peak hour traffic flows whereby opening of the bridge during these times will be restricted to commercial craft only. The activation for the opening of the bridge to canal traffic will be as per the existing situation whereby the operator of the previous bridge will inform the bridge keeper that a craft is on its way.

3. This scheme may be cited as “The Gloucestershire County Council (Two Mile Bend Bridge) Scheme 2001”.
