In exercise of the power conferred on the Secretary of State by section 50(3)(b) of the School Standards and Framework Act 1998( 1 ), the Secretary of State for Education and Skills hereby makes the following Regulations:

1. —(1) These Regulations may be cited as the School Budget Shares (Prescribed Purposes) (England) Regulations 2002 and shall come into force on 1st April 2002.

(2) These Regulations shall apply for the purposes of the expenditure of budget shares of maintained schools in England.

2. In these Regulationsmaintained school” means a community, foundation or voluntary school or a community or foundation special school.

3. The following purposes are hereby prescribed for the expenditure of the budget share of a maintained school by its governing body—

(a) the provision of teaching to pupils registered at other maintained schools;

(b) the provision of learning materials, educational resources, transport, meals and accommodation for pupils registered at other maintained schools.

4. These purposes are prescribed subject to the condition that the governing body by 30th June each year submits to the local education authority maintaining the school a statement, in a form determined and published by the local education authority, setting out details of the provision made in the preceding financial year in accordance with these Regulations, and the expenditure on that provision.
