London Service Permits (Appeals) Regulations 2002

The Secretary of State for Transport, Local Government and the Regions, in exercise of the powers conferred upon him by section 189(5) of the Greater London Authority Act 1999( 1 ) hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the London Service Permits (Appeals) Regulations 2002 and shall come into force on 1st April 2002.

Interpretation

2. In these Regulations—

appeal” means an appeal under section 189 of the Greater London Authority Act 1999 ;

the Panel” means the appeal panel appointed by the Lord Chancellor under section 189 of that Act .

Making of appeal

3. —(1) An appeal shall be made by serving notice of appeal in writing on the Panel.

(2) The notice of appeal shall be signed and dated by or on behalf of the appellant and shall state:

(a) the name and address for service of the appellant;

(b) the details of the decision against which the appeal is brought; and

(c) the grounds for the appeal.

(3) At the same time as the appellant serves notice of appeal on the Panel he shall send a copy to Transport for London.

Service of documents

4. —(1) The notice of appeal and the copy of that notice, may be served by being—

(a) delivered by hand to the proper address of the recipient;

(b) sent by post to that address; or

(c) sent in such other manner as the Panel may accept.

(2) For the purposes of paragraph (1) the proper address of the Panel or Transport for London is—

(a) their principal office, or

(b) (if different) the address which they have specified to the applicant as being the address at which they will accept service for the purpose of these Regulations.
