The Air Navigation (General) (Amendment) Regulations 2002

The Secretary of State for Transport, Local Government and the Regions, in exercise of the powers conferred by article 36(1) of the Air Navigation Order 2000( 1 ) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

1. These Regulations may be cited as the Air Navigation (General) (Amendment) Regulations 2002 and shall come into force on 3rd April 2002.

2. The Air Navigation (General) Regulations 1993( 2 ) shall be amended as follows.

3. —(1) In regulation 9 for “the cloud ceiling or visibility prevailing at the aerodrome of departure and forecast for the estimated time of landing at the aerodrome at which it is intended to land and at any alternate aerodrome” there shall be substituted “the cloud ceiling or visibility prevailing at the aerodrome of departure or forecast for the estimated time of landing at the aerodrome at which it is intended to land or at any alternate aerodrome”.

(2) In regulation 10(2) for “the cloud ceiling or visibility prevailing at the aerodrome of departure and forecast for the estimated time of landing at the aerodrome at which it is intended to land and at any alternate aerodrome” there shall be substituted “the cloud ceiling or visibility prevailing at the aerodrome of departure or forecast for the estimated time of landing at the aerodrome at which it is intended to land or at any alternate aerodrome”.

(3) In regulation 11(6):

(a) for “a single engined aeroplane designated as aforesaid”; there shall be substituted “an aeroplane with one power-unit designated as aforesaid”; and

(b) for “the aerodrome at which it is intended to land and at any alternate aerodrome” there shall be substituted “the aerodrome at which it is intended to land or at any alternate aerodrome”.

(4) In paragraph (11) of the Schedule for “the cloud ceiling or visibility prevailing at the aerodrome of departure and forecast for the estimated time of landing at the aerodrome of destination” there shall be substituted “the cloud ceiling or visibility prevailing at the aerodrome of departure or forecast for the estimated time of landing at the aerodrome at which it is intended to land”.

S.I. 2000/1562 as amended by S.I. 2001/397 . The expression “prescribed” in article 36 is defined in article 129(1) of the Air Navigation Order 2000. The power enabling that Order to authorise the Secretary of State to make regulations is set out in paragraph 3 of Part III of Schedule 13 to the Civil Aviation Act 1982 (c. 16) .
