Whereas the Secretary of State for Education and Skills has received a proposal from the Learning and Skills Council for England, made in accordance with section 51 of the Further and Higher Education Act 1992( 1 ) (βthe Actβ), for the dissolution under section 27 of the Act of the further education corporations known as Rycotewood College, Oxford College of Further Education, and North Oxfordshire College and school of Art(( 2 )) (βthe corporationsβ);
Now therefore, in exercise of the powers conferred on him by section 27 of the Act, the Secretary of State, after consulting each of the corporations and with the consent of the further education corporation known as the Oxford and Cherwell College( 3 ) hereby makes the following Order:
1. This Order may be cited as the Rycotewood College, Oxford College of Further Education and North Oxfordshire College and School of Art (Dissolution) Order 2003 and shall come into force on 1st August 2003.
2. On 1st August 2003 each of the corporations shall be dissolved and all of their property, rights and liabilities shall be transferred to Oxford and Cherwell College being a body corporate established for purposes which include the provision of educational facilities or services.
3. Section 26(2), (3) and (4) of the Act shall apply to any person employed by any of the corporations immediately before 1st August 2003 as if the references in that sectionβ
(a) to a person to whom that section applies were to a person so employed;
(b) to the operative date were to 1st August 2003;
(c) to the transferor were to the corporation in question; and
(d) to the corporation were to Oxford and Cherwell College.
