The Education (School Teachers' Pay and Conditions) (Amendment) Regulations 2003

In exercise of the powers conferred upon the Secretary of State by section 214 of the Education Act 2002( 1 ) the Secretary of State for Education and Skills hereby makes the following Regulations:

Citation, commencement and application

1. These Regulations may be cited as the Education (School Teachers' Pay and Conditions) (Amendment) Regulations 2003 and shall come into force on 1st August 2003.

2. These Regulations apply in relation to England and Wales.

Interpretation

3. In these Regulationsthe School Teachers Pay and Conditions Document 2002” means the document brought into effect by article 3 of the Education (School Teachers' Pay and Conditions) (No. 2) Order 2002( 2 ) and as amended by the Education (School Teachers' Pay and Conditions) Order 2003( 3 ).

Amendment to the School Teachers' Pay and Conditions Document 2002

4. Paragraph 1.2 of the School Teachers' Pay and Conditions Document 2002( 4 ) is amended as follows.

5. Insert the following words after “Regulations” in the definition of “Employment-based teacher training scheme” –

or paragraph 10 of Schedule 2 to the Education (School Teachers' Qualifications) (England) Regulations 2003 ( 5 ) .

6. Substitute the following definition for the definition of “qualified teacher” –

“qualified teacher” means a person who satisfies requirements specified in regulations made under section 132 of the Education Act 2002 ( 6 ) ; .

7. Substitute the following definition for the definition of “unqualified teacher” —

“unqualified teacher” means a person who is a school teacher within the meaning of section 122(5) of the Education Act 2002 ( 7 ) ; .

In relation to England the current Regulations are the Education (School Teachers' Qualifications) (England) Regulations 2003. In relation to Wales, regulation 6(1) of the Education Act 2002 (Transitional Provisions) (Wales) Regulations 2002 (S.I. 2002/3184 ) provides that until Regulations under section 132 of the 2002 Act come into force, a reference to a “qualified teacher” has the meaning in section 218(2) of the Education Reform Act 1988 (c. 40) .
