In exercise of the powers conferred on the Secretary of State by sections 19 and 54(3) of the Education Act 1997( 1 ), the Secretary of State for Education and Skills hereby makes the following Regulations:
Citation and commencement
1. These Regulations may be cited as the Education (School Performance Targets) (Amendment) (England) Regulations 2003 and shall come into force on 1st September 2003.
2. The Education (School Performance Targets) (England) Regulations 1998( 2 ) shall be amended as set out in regulations 3 to 5 of these Regulations.
3. —(1) Amend regulation 4 (targets for pupils aged 15) as follows.
(2) Omit paragraph (3)(b).
(3) For paragraph (4) substitute:
“ In paragraph (3)(a), the reference to pupils achieving particular grades in GCSE examinations shall be construed for the purposes of that provision so as to include a reference to pupils achieving corresponding awards in an equivalent number of vocational qualifications. ” .
4. —(1) Amend regulation 5 (prohibition of revision of performance targets) as follows.
(2) Re-number the existing text as paragraph (1) and insert at the beginning of the sentence:
“ Subject to paragraph (2), ” .
(3) After that paragraph insert the following new paragraph—
“ (2) The governing body of a school to which regulation 3 applies may amend the targets it has set pursuant to regulation 3 for the school year 2003-04 when it sets targets pursuant to regulation 3 for the school year 2004-05. ” .
5. —(1) Amend regulation 6 (publication of performance information) as follows.
(2) After paragraph (2B) insert—
“ (2C) Paragraph (1) shall not require the governing body to publish information relating to any amendment made under regulation 5(2) to the performance targets set pursuant to regulation 3 for the school year 2003-04. ” .
(3) In paragraph (5) omit sub-paragraph (b)(ii).
(4) For paragraph (6) substitute—
“ In paragraph (5)(b)(i), the reference to pupils achieving particular grades in GCSE examinations shall be construed for the purposes of that provision so as to include a reference to pupils achieving corresponding awards in an equivalent number of vocational qualifications. ” .
