The First Secretary of State, in exercise of the powers conferred upon him by section 1(5) and (6) of the Local Authorities (Goods and Services) Act 1970( 1 ) hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Local Authorities (Goods and Services) (Public Bodies) (England) (No.3) Order 2003 and shall come into force on 8th September 2003.

Designation as a public body

2. Each of the following bodies, being a person appearing to the Secretary of State to be exercising a function of a public nature, shall be a public body for the purposes of the Local Authorities (Goods and Services) Act 1970, in its application to England( 2 ):

Restrictions on agreements—Doncaster Dome Leisure Trust

3. Agreements which may be entered into by Doncaster Dome Leisure Trust, by virtue of this Order, shall be subject to the following restrictions—

(a) that any such agreements are for the supply of property management or grounds maintenance services by Doncaster Metropolitan Borough Council; and

(b) that any such agreements are made in connection with the provision of services in the area of Doncaster Metropolitan Borough Council.

Restrictions on agreements—Wigan Leisure and Culture Trust

4. Agreements which may be entered into by Wigan Leisure and Culture Trust, by virtue of this Order, shall be subject to the following restrictions—

(a) that any such agreements are for the supply of general administrative, security, financial, legal, transport, vehicle repairs and maintenance, vehicle hire, payroll, information communication technology, property management, building, procurement, personnel or performance review services by Wigan Metropolitan Borough Council; and

(b) that any such agreements are made in connection with the provision of services in the area of Wigan Metropolitan Borough Council.

Restrictions on agreements—Trafford Community Leisure Trust

5. Agreements which may be entered into by Trafford Community Leisure Trust, by virtue of this Order, shall be subject to the following restrictions—

(a) that any such agreements are for the supply of payroll, revenue collection, information technology, legal, grounds maintenance, personnel, procurement, property management or building services by Trafford Metropolitan Borough Council; and

(b) that any such agreements are made in connection with the provision of services in the area of Trafford Metropolitan Borough Council.

The Secretary of State’s functions under the Local Authorities (Goods and Services) Act 1970, so far as exercisable in relation to Wales, are transferred to the National Assembly for Wales, see article 2 and Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 ( S.I. 1999/672 ), to which there are amendments not relevant to this Order.
