INTERNATIONAL IMMUNITIES AND PRIVILEGES

The Vienna Document 1999 (Privileges and Immunities) Order 2003

Whereas a draft of this Order has been laid before Parliament in accordance with section 1(2) of the Arms Control and Disarmament (Privileges and Immunities) Act 1988( 1 ) and has been approved by resolution of each House of Parliament:

Now, therefore, Her Majesty, by virtue and in exercise of the powers conferred on Her by section 1(2) of the said Act of 1988 or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

1. β€”(1) This Order may be cited as the Vienna Document 1999 (Privileges and Immunities) Order 2003. It shall come into force forthwith.

(2) In this Order β€œthe Vienna Document 1999” means the Vienna Document 1999 of the Negotiations on Confidence- and Security-Building Measures adopted by the participating States of the Organisation for Security and Co-operation in Europe at Istanbul on 16th November 1999( 2 ).

2. Persons designated by a State other than the United Kingdom as observers, inspectors or evaluators under the Vienna Document 1999 shall enjoy, during their mission, the like privileges and immunities as are accorded to or in respect of diplomatic agents by the Diplomatic Privileges Act 1964( 3 ).

3. Persons designated by a State other than the United Kingdom as auxiliary personnel for an inspection or evaluation carried out under the Vienna Document 1999 and performing administrative and technical services, or domestic services, shall enjoy, during their mission, the like privileges and immunities as are accorded to or in respect of members of the administrative and technical staff or, as the case may be, of the service staff of a mission by the Diplomatic Privileges Act 1964.

4. The Vienna Document 1992 (Privileges and Immunities) Order 1992( 4 ) is hereby revoked.
