The First Secretary of State, in exercise of the powers conferred upon him by sections 1(5) and (6) of the Local Authorities (Goods and Services) Act 1970( 1 ), hereby makes the following Order:

Citation, commencement and extent

1. This Order may be cited as the Local Authorities (Goods and Services) (Public Bodies) (England) Order 2003 and shall come into force on 21st March 2003.

Designation as a public body

2. Each of the following bodies, being a person appearing to the Secretary of State, to be exercising a function of a public nature, shall be a public body for the purposes of the Local Authorities (Goods and Services) Act 1970, in its application to England( 2 ):

Restrictions on agreements—Swaythling Parochial Church Council

3. Agreements which may be entered into by Swaythling Parochial Church Council by virtue of this Order shall be subject to the following restrictions—

(a) that any such agreements are for the supply of stationery, furniture and general goods to it by Hampshire County Council; and

(b) that any such agreements are made in connection with the provision of services in the area of Hampshire County Council.

(a) that any such agreements are for the supply of goods or materials, or the provision of administrative, professional or technical services, to it by the City of York Council; and

(b) that any such agreements are entered into during a period in respect of which it is in receipt of a grant from the City of York Council; and

(c) that any agreements are made in connection with the provision of museums, galleries and educational facilities in the area of the City of York Council.

Restrictions on agreements—South Lakeland Leisure

5. Agreements which may be entered into by South Lakeland Leisure by virtue of this Order shall be subject to the following restrictions—

(a) that any such agreements are for the supply of goods or materials, or the provision of administrative, professional or technical services, to it by South Lakeland District Council; and

(b) that any such agreements are entered into during a period in respect of which it is in receipt of a grant from South Lakeland District Council; and

(c) that any agreements are made in connection with the provision of recreational facilities in the area of South Lakeland District Council.

The Secretary of State’s functions under the Local Authorities (Goods and Services) Act 1970, so far as exercisable in relation to Wales, are transferred to the National Assembly for Wales; see article 2 and Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 ( S.I. 1999/672 ), to which there are amendments not relevant to this Order.
